I've said, many times now, that this is just my perspective. That I understand it doesn't match society's construct. That I'm not claiming my perspective is any more right or just than any other perspective. That it is simply mine.

You can't have missed me acknowledging that, all the times I did.

I'm not misrepresenting your position. I fully appreciate that we are discussing matters of perspective.

I am just surprised that they could not get together and settle the matter without going to court. Ohio State was clearly wrong not to ask, but hard to imagine could not settle it themselves.

The outcome of this case could have major implications for the current college sports model. Settling it will not be cut-and-dried.

I meant him just going to Ohio State and talking it out when noticed poster and avoid ugly law suit.

Unless you are saying he feels he should go to court because he wants to settle matter for all past, present, and future interests.

But now it is out in public, he should have settled this behind closed doors and avoid the bad image to his school. ( I do not care that everyone knows how greedy they are, but you would think he would not want to tarnish their image)

The schools have had decades to stop with this crap. You can't protect the reputation of an institution that steadfastly refuses to do the right thing.

Wouldn't me taking a picture of any marketing object then allow me the right to use it for profit? I can't use a logo for my financial gain without permission of a company, an image that represents them. They can't use my picture for the same, an image that represents me.

I never understood the legal construct that a person's likeness or image is a possession of his.

It's almost like the modern-day version of the legend that the Mayans and other native American and Australian cultures believed mirrors (and by extension, cameras) could steal one's soul.

I'm on vacation with my family in Disney World. Some other dude on vacation with his family snaps a photo that happens to include me in the background. So I somehow have a legal right to a portion of his photo?

Just doesn't make sense to me. What you, or anyone else, capture in the open air, in a public place, that's yours far as I can see.

Nothing against Spielman or any other player who wants money for playing football (in college or elsewhere), I just don't get the whole "likeness and image" property angle.

I'm pretty sure if your personal image was generating substantial income, landing in another's pocket, and not in your pocket, you would have a problem with it.

I don't think so. First, I don't think of that image as mine. Would never cross my mind to ask for money for it. Second, I'm not rich but I'm fine for money. More would just be more.

This guy is a whiner.

People can complain about the NCAA and the current model all they want but one day it's gonna get scrapped and I'm betting what replaces it isn't better.

Often we think so-called progress = better but in reality it's not.

Put Peyton on a poster that also features the Pizza Hut logo and I guarantee the school will get a C&D letter from Peyton's attorney.

If the school didn't respond to the C&D, then yes, Peyton would absolutely file a lawsuit.

And my understanding is that Spielman has dealt with this issue with tOSU before, and has now decided to sue to get it to stop for good.

Can't assume your perspective is the perspective of others. He very well might not. And it is entirely possible that these exact circumstances have come up for Peyton and UT in the past.

He's not just a spokesperson. He's got ownership. Maybe even qualifies as a partnership. He's obligated.

Zero chance Peyton Manning ever sues UT for using his likeness.

One, UT is not wreckless. Two, Peyton isn't looking to solve the world's "problems." Three, he would look to handle it quietly if there was any issue.
