Depends on the facts. Was he acting as Trump's attorney? Was Trump asking for or was Cohen providing legal advice? Was the communication in furtherance of a crime?

A little context.


Arnold then told NBC News that he met with Cohen as part of a show he is working on for Vice, in which he searches for incriminating videos of the president.
"This dude has all the tapes–this dude has everything,” Arnold told NBC News. "I say to Michael, 'Guess what? We’re taking Trump down together,’ and he’s so tired he’s like, 'OK,' and his wife is like, 'OK, f--- Trump.’”


"We’ve been on the other side of the table and now we’re on the same side," Arnold told NBC News. "It’s on! I hope [Trump] sees the picture of me and Michael Cohen and it haunts his dreams.”

Yep. Trump might be making a serious mistake distancing himself from him. He's forcing him into a flip. Probably some more bad direction from Rudy.

I'll put some faith in Tom Arnold when he actually brings the goods. He's been talking about incriminating evidence since the election and he hasn't produced squat yet.

For anyone that cares, Michael Cohen "has broken his silence" and will sit down with George Stephenopoulis for GMA this morning at 7ET. It's not on camera but the discussion will be revealed. Could be interesting, could be nothing. A snippet:


When I asked Cohen directly what he would do if prosecutors forced him to choose between protecting the president and protecting his family, he said his family is “my first priority.”



Cohen added: “Once I understand what charges might be filed against me, if any at all, I will defer to my new counsel, Guy Petrillo, for guidance.”



But when I pointed out to Cohen that he wasn’t repeating past vows to “take a bullet” and “do anything” to protect the president, the longtime Trump loyalist left little doubt about where he stands now, saying simply: “To be crystal clear, my wife, my daughter and my son, and this country have my first loyalty.”
