Add another notch on Barry's belt. The Obama Administration has killed any sense of faith in, pride for, respect of, and integrity of a once proud organization. It'll take years/decades to recover.

I remember reading a rundown of the case and it didn’t sound like la slam dunk criminal case against McCabe for lying, that may have been a consideration.

Usually if a prosecutor has a charge they go ahead and bring it to add leverage. Unusual, IME, to decline a charge if you’re planning to bring something else later (see e.g. Manafort).

Maybe it’s just me, but I think criminal investigations of the top management of the FBI is pretty damn unusual.

I heard Bongino say he thought this was a loser case similar to the Greg Craig case that the DOJ already lost.
Ive heard the same and that may be where the difference is. FBI senior leadership = high profile. Bringing any case sets expectations and nobody wants to oversell and under deliver.
 
What about that would change the practice of how you prosecute the cases?

As an engineer, if there were allegations of questionable integrity about data presented to me, I'd have a hard time justifying the analysis of that data. I would think prosecutors would have similar moral issues about potentially ruining a person if they had doubts about the process that alleged the person had done wrong.

They usually don’t.

Sounds like you are from the other side of that legal fence.

It’s a nuanced question.

Sometimes it’s good, sometimes it’s bad. Somebody reasonably advanced at DOJ should have the time to know their case well enough to know if it’s appropriate in this case.

The problem I usually have is when and against whom state prosecutors, who have a lot more on their plate, decide to employ those tactics.

I've always heard panic can make you go full triggered.




I am in continual awe of the great people of the Democrat party. They are completely incapable of bias. Meanwhile, any Republican is surely only doing things for party over country and most likely trying to defraud the public and possible kill innocent people.
