Yes, and I agree with you that maybe that was his intention and didn't execute well. However, poor execution is a problem in many DUI cases.

I agree with you on all except the "lock your keys in the trunk."

Your not understanding. He was near campus not near the bar. He had to leave the bar and drive to where he was sitting when he passed out.

There was no good decision. He got to where he was going but passed out once he parked.

I suppose you aren't familiar with Tuscaloosa, but there are several bars just off campus.

Let's not pretend that we have a significant portion of candidates who are running on that premise or that laws represent the will of the people in general.

Kind of how our republic works.

But that being said, that's really not the discussion. The law isn't changing, and it's actually getting tougher. I don't have influence over that. I have to defend people based on how it's written.

I believe most cars have the ability to pop your truck from inside or unlock the car and have a push button on the trunk. Nowadays, I think it can be done in a vast majority of vehicles.

Volfaninbama explaining it. I haven't followed it anymore. I knew he would get off. If they are now playing the "he walked out of the bar and went to sleep to keep from driving" you'll never find a link or the truth.

The headlight thing might be a deal breaker for him. If it isn't a car with automatic headlights that come on at night does this show he intended to drive?
 
It's not changing. It's been on the books for a while, and MADD has a strong lobbying group in TN. The laws are getting tougher; not the other way around.

It needs to change (all states don't have the same stupid law). So if you're going to be charged for DUI while sleeping it off in your car, you'll be more inclined to attempt to drive home to get to a place that you will not be arrested. That is stupid. It is far better to sleep it off in your car than to attempt to drive home. It's not even close and MADD is wrong.
 
Absolutely not, i arrest a guy once i knew was drunk and leaving a gas station. The guy was slick and had a toogle switch and used that as a defense that is car was inoperable. I guess he was too drunk to remember that we started his car to check after he told us his battery was dead. If you take away that law the guy drives away. There is a good use for the law. Cops are not walking through parking lots arresting people with keys in their pockets man cmon on.

I expained this in another post and actually gave an example. For APC, courts look for, keys in ignition, driver behind wheel, car is operable. Like i said, people are not getting DUIs for doing tue right thing.

The lights were on and engine running. Volfaninbama can correct me if I'm wrong with his profession but I'm pretty sure whether the car is running or not the keys just have to be in the ignition to get a DUI or DWI.

Which is a bull**** law and I have always believed that. It's akin to giving a ticket to a guy for texting while driving while he is parked in a parking lot.

IMO it is exactly the same. The purpose of DWI/DUI laws are to prevent you from operating a vehicle on the roads to protect yourself and other drivers. You are posing no threat at all to harm yourself of others by sitting in a parking lot in a non moving vehicle drunk. JMO and I know its not a popular opinion.

There was a Knoxville lawyer on the radio yesterday saying that there are DUIs being given to people sleeping in their cars with keys in their pocket. In the ignition shouldn't matter either... the engine has to be on to run the heater or the A/C. This just gives the cops yet another opportunity to harass citizens.
 
There's also people getting DUI's despite testing negative for drugs or alcohol

It happens often that people read something about a law and dont understand its practical application. I get it.
