Dealership wrecked MY brand new car

They should have offered to fix it but I don't think the OP's insurance should be the one paying for the repair.

They wouldn't have. They would have paid maybe initially, but they would have subrogated. The money would be right back to them. We are dealing with a suit like that right now.

You are speaking insurance to me... What does the subrogate mean? They pay the claim and then go after the dealership's insurance to recoup?

Yes. That is one reason why you have insurance- so that yours will take care of you quickly and then it's your insurance company's responsibility to get paid back.

Not much going on. Car is in the shop, but still not repaired. Next week, I'll continue on with my negotiation for DV.

It could be worse, someone showed me this today:

Dealership Totals Customer's Camaro ZL1, Owner And Dealer At War

I lost sympathy here:

The Hoopers didn't just buy their show-worthy black ZL1 for $60,000. They had to trade in a 2011 Camaro SS and also sell their pristine 1969 Camaro SS as well to get the new car. By all appearances, they loved their ZL1.

OP - sue the dealership AND the mechanic that wrecked it - since he should be named on the police report

Probably switching the new engine with a used one and likely with other parts --- place is taking the OP for a sucker bigtime
