Dealership wrecked MY brand new car

I mean...they aren't fixing anything, unless stuff has changed. It's sitting there while he's waiting for them to either give him thousands in DV or give him a new car. It's not about how much damage was done or if the frame was affected.
 
He's also making payments on a car he hasn't been in possession of for at least 30 days.

You're saying he should have just had them repair the car to like new condition and been done with it? Yes.

He's not only making payments for the car he's also paying for the insurance on it as well as it just sits there.

Imo, they should give him a new car. Fix his old one and use it as a loaner.

He took them a brand new vehicle. He should get a brand new vehicle back.

That's my only thing...the dealership has been garbage but I don't think they owe him a zero mile car either.

I disagree. His time is worth it. All they have put him through?

Yeah, at this point, I could see that to make up for time and wash their hands of it.

I thought some were advocating a new car the day it happened though. That's where I was a bit confused...
 
They don't, but I understand why he'd lose his mind over what happened.

Oh no doubt. Whole situation is ridiculous.

Reminds me of a couple of Oak Ridge dealerships or a certain Clinton Hwy operation that constantly changes hands.

Sad that so many dealerships just flat don't give a damn.

I agree that the dealership is handling this extremely poorly, but the second that car drove off the lot it wasn't a new car.

I've bought enough of them to understand depreciation. That's one of the reasons I always buy Ford. I use the X plan. Generally saves me 6-10k off the sticker.

In this situation though, had the dealer stepped up right away, I think it would be a non issue. But, them playing games like this, it merits a new car. Find him a demo with 5k miles on it and traded him out.

I disagree, at no point is he warranted a brand new car. What games are they playing???? OP has not given us many details since the beginning as to what he has done and how the dealership has responded. The dealership responded with fixing the car back and op said no. Since then what exactly has the op done for it to warrant a new response? Has he made a new demand? Did he get an attorney? Etc. If the op hasn't done much of anything, I would not be offering more if I were the dealership.

That's not how this works.

They damaged (severely) his new car. They didn't offer to fix it. They wanted him to file it on his insurance. That's a no no.

They have jerked him around, hence playing games.

I've seen this type of thing happen. The customers were getting their first oil change. 3,000 mile service. Tech dropped it on the rack. They went up front, found the customers, took them out on the lot and let them pick out a new one. This was a small Chevy dealer that did this.

That's how is supposed to be done. Not all this running around they are making him do. He should never had to even fathom the idea of an attorney.
