I am not sure an attorney would speed things up. It might slow things down. In my experience working in dealerships generally if a customer brings a lawyer into a situation the GM is going to turn things over to the dealerships lawyer and let the lawyers work things out. Now this is just in my experience and I am in no way saying its the wrong thing to do but I am saying that I don't think it would speed things up.
 
Well, I finally got my answer. I'm supposed to use my insurance to call theirs and mediate a deal which means that my car will be fixed to reasonable standards and I'm just screwed over the diminished value.

Don't give up - their insurance should cover the DV.

I still would get an attorney and demand a brand new vehicle
 
Yup, pretty sure if their mechanic was driving a vehicle that the owners insurance will not have to pay for this....all on the dealership or mechanics insurance.
They claimed that the contract my wife signed relieves them of liability when she placed the car in service. Only problem: My wife never signed ANYTHING when she came for the service.
 
Misunderstood. They are going to try and force my insurance to be the primary. So my insurance will take the hit on future premiums and no DV will be covered.
Time to lawyer up......that's ridiculous

Also, before you even go that route, make sure you go to the dealership and take photos of your wrecked vehicle if you havent already

Goes without saying, but ask for them to provide subject document with her said signature

That's just ridiculous. Stop talking to them and turn it over to your insurance company and let them fight it out.

If they continue to stall and be beligerent, Time to blow up their yelp (and other review) media.

Sometimes the mere threat of legal action is enough to get things moving in the right direction.
 
Yeah, the damage is 8-10k, but the difference in a repaired vehicle and a brand new one is the issue; not the total bill.

But when they are trying to put it on his insurance company, the lingering costs from that to his policy would make it worth it I would imagine.

Imo...still not worth $2-300 an hour to avoid an annual premium increase of a few hundred and a deductble.

I make decent money. At this point it's more about the principle than the money. I am furious at the complete disregard of the situation.

They cant put it on his insurance.

They took possession.

Even if he subs it still won't be coded that way.

Call your agent abd get him involved.

I believe that is what they are trying to accomplish here.
