Dealership wrecked MY brand new car

You obviously have no idea what you are talking about. Take two cars, same year, miles, color, etc. One has a clean Carfax with no previous damage. The other has a Carfax accident report and $8k worth of damage, which has been repaired.
You saying you'd consider both of equal value?
Diminished value has been part of Tennessee insurance for a long time. There are actually official dimished value claims adjusters.

I've never seen the level of idiocy run amuck in this thread.

In short, you're an idiot if you think a Carfax reports are accurate.
 
Diminished value onky comes in where there is no fault collision.

Damage at the dealership would probably not be coded as collision unless they were driving the vehicle abd wrecked it.

Dv would not apply if mechanic messed it up or dropped it off the rack.

Could a claim rep be nice abd give DV?

Yes...but it wouldn't be due to the law in tn.
In regards to the OP it was my understanding that the tech was driving the vehicle and wrecked it. If I've misunderstood apologies. Whether the specific accident fits, he can still get a DV claim and pursue. And, he'd win if it made it to small claims.

The information in them can be accurate yes, but they can also be missing huge chunks of critical information.

Its a feel good tool at best.

Carfax sucks. Missing data, bad data, etc. If a car ever gets put on a frame machine just to be checked, then it has to be reported as possible frame damage, which scares everyone.
 
If the diminished value is settled correctly, what difference does it make though?

I didn't buy a brand new vehicle to have one with diminished value.

Never talked to the GM on Friday as I was out of town for the holidays, not that anyone ever bothered calling me. Will continue this tomorrow.

Well then it depends on what his actual job there is -- a top notch mechanic or a lacky that changes oil or puts air in tires -- top notch mechanics are a little bit harder to replace

with it being the guy they had taking the car out to figure out the issue, I'd assume he's more of the mechanic and less of the oil dude

Searching for advice on this. Bought a car a couple of months ago and the wife was taking it to a closer dealership for it's very first oil change. On the way there, my wife noticed a slight miss when it was at idle and wanted to know if they could check it out. They decided to take it on a test run to find the issue and the mechanic wrecked the car in their own parking lot against a trailer of some kind. Not sure the details, but my car is scraped all the way down the side and gashed the wheel (not tire though). The scrape is deep enough that will require all parts to be replaced and one door is dented in.

The dealership has accepted responsibility but has only offered to fix the car. My problem is that I will now own a brand new car with a bad title that has certainly devalued my car by thousands even when fixed. I have called on several occasions to talk to the GM or owner but the best they can offer me is the service manager, who cannot get me anything approved over what they have already offered which I HAVE NOT ACCEPTED. They said the GM wouldn't be in until Friday and they never see the owner.

I guess my question is, what kind of advice would you give me?

First of all, sorry for your situation. It kinda sucks and I get where you are coming from. You brought your basically brand new car in for service....and they wrecked it and have diminished it's value.

Now, I don't have any legal advice for you so I have no idea what the dealership is obligated to do for you. My guess is that they have no more obligation to you than to fix/repair your vehicle or have it fixed/repaired at a place of your choosing. Essentially, they aren't any more obligated to give you a new car than any regular motorist that would have sideswiped you out on the highway. I don't think that this would have any impact on the title of your car, but you may have been better off if it had been totaled, putting the dealership on the hook for essentially having to buy your car.

The other factor that is probably going to go against you is that you weren't at the dealership where you purchased your vehicle. I would think that if you had been at the selling dealership, they would be more inclined to make you happy. Unless this other dealership is a part of that same group, they probably aren't invested in making you happy, and will be even less inclined to help if you are being an ass (which from your standpoint, being an ass might be totally justified). I just wouldn't go that route until I had to.

Perhaps if you put a call into the dealership where you purchased the car, maybe they might be able to give you some advice, help you out, or make a phone call for you. I don't know. But it wouldn't hurt to call them and let them know what happened, especially if you've been a loyal customer.

What should happen? I personally feel that if fixing the vehicle isn't what you want, then the dealership has the capacity to buy your car from you. They should give you your original purchase price, if for no other reason than to save face. At that point, you'd be back to where you started and they'd own your wrecked car. They could repair it, resell it, and make back most of their money.

My dad pulled up a Carfax report on his Honda Odyssey some months after he bought it brand new off the Honda lot and it came back with a wreck report allegedly occurring before he even purchased the van. A lengthy inquiry into both the dealership and Carfax and the situation ultimately yielded a letter from Carfax saying "we're sorry, we incorrectly reported damage to your vehicle when there clearly was none."
 
I wouldnt let them fix it if that is what you have to settle for...........make them pay another repair shop that way they cant cut corners and save money.
 
Did you happen to sign a work order before they actually did the work? Do you have a copy of that work order and have you looked over it for something that covers a hold harmless agreement?

No work has been done because I have yet to speak with anyone that can really make a decision on how the matter is supposed to be handled. But it only happened 11 days ago.:ermm:

I think he meant signing anything before they initially took the car out and wrecked it

No matter what happens there is no reason that a customer should not have an answer faster than this. My guess is they are trying to fix the car before anything can be discussed.

Keep us update 9296 because I will be interested to hear the out come of this situation.
