I'd say you're right. He'll probably get a Dishonorable.

A commissioned officer cannot receive a dishonorable, only a dismissal. The most he will get, imo, is an admin seperation, not punitive. But thats jmo

That's not true. Commissioned officers get DDs.

He makes too much noise and acts foolish in trying to embarrass the CinC and they'll make an example of him.

The problem with his logic is that any member of the military could question the authority of the CinC to give an order. Imagine members of the Iraqi deployment saying they wouldn't go because they questioned whetherBush had the authority to declare war under the WPA.

The guy's a tool.

His logic is fine as is anyone else's raising a question. His problem is that, by law, he is obligated to follow the orders of those appointed over him, period. His little charade will not end well.

Oh, he's of course free to have his opinion. But, not only is it not his role to be the decider of Obama's eligibility to be the POTUS, it is also the case that his refusal to follow an order based on this is simply illegal.

I think we are on the same page.

I have no idea why LG brought up Hutaree but the civil war is an interesting question.

Did the south have a legal right to do what they did?
