No actually there is not and we can thank President Clinton for that and his sock drawer of tapes.There is need. He is the one who was violating the Presidential Records Act of 1978, and withholding Presidential records from the National Archives and Records Administration after leaving office. He was breaking the law, and obstructing an investigation in the process by defying a subpoena. He also had two classified documents uncovered in that storage unit, after telling the FBI that all of the classified material had already been handed over.
You fail to understand that under the Presidential Records Act of 1978, the President is legally obligated to turn over his records to the National Archives and Records Administration (NARA) upon leaving office. That is because under this law, those records are not considered the personal property of the President, but rather the property of the United States. Donald Trump was in clear violation of this law for over a year, and he still refused to comply with it, even after he was served with a subpoena for those records by the FBI. ... and Trump, as a former President after January 20, 2021, did not have the right to withhold Presidential records from the National Archives and Records Administration, in violation of the Presidential Records Act of 1978, but that is exactly what he did, even after being served with a subpoena for them by the FBI.
It's still an open investigation ... and the DOJ doesn't want to go after a former President for obvious reasons. They gave Trump 5 months to hand those records over to the National Archives and Records Administration after serving him with a subpoena. I don't think that they wanted to raid Mar-a-Lago, Trump had made it clear that he was never going to comply.Why hasn't he been prosecuted then?
