Federal Indictment of Donald Trump

If you’d care to look back a few posts, I pointed out that I was saying relative to similarly situated whites engaging in same conduct. The last figure I saw was close to 20% longer sentences for black males vs white males.

So? It’s impossible to judge sentence length without taking into account A LOT of other factors. If Leroy gets 20 years for armed robbery and Jacob gets 3 for the same crime is it because Leroy has a record with multiple offenses and Jacob didn’t have any?

Sure it makes total sense that a criminal defense attorney in a midsize city that has tried multiple “serious” efforts to do something about its “gang problem” doesn’t know anything about law enforcement efforts to combat gangs. Go to bed. You’re drunk.

Demonstrate even marginal comprehension or even genuine curiosity about the issue and I’ll be happy to talk about it. Continue sophomoric baiting and sounding like you’re lying about watching cable news and I’m not.

Doesn’t matter to me which way it goes.

It’s not up to the “system” to fix the root causes of criminal behavior. Just lock them up as long as possible.

Forget Trump. A corrupt DOJ is bad period. The same people chortling in this thread, starting off posts with lol or haha will be screaming bloody murder if the DOJ switches sides.

The same people that screamed Comey and the FBI were interfering in the 2016 election. Comey is a partisan hack.

You should want a non partisan DOJ. The fact that congress holds their purse strings and the president can put his guy in at the top should worry everyone.

He’s done no more than every other president and vp and yet he’s the one they go after. Hillary? Nope Biden? Nope. Trump oh hell get him. Now why the difference?
His stance of screw you I don’t have anything despite evidence to the contrary. His claims of I just need to think them declassified and it’s so. His claims of I do whatever I want and get away with it.

Trump broke the law. He deserves to be prosecuted. Hillary broke the law and even had her people destroying evidence, smashing up devices. That was pretty egregious and just as much an FU as Trump's behavior IMO, but in the end, she was protected when she should have been prosecuted. Potentially, Biden and Pence should face charges for the mishandling of classified information. But what really scares me in their situations is how seemingly no one was aware they even had this information. With Trump, they seemed to know what documents he had. But with Biden and Pence.... Is our handling of classified materials so inept that they could hold onto classified documents for years with no one the wiser? That's alarming to me. Another sign of a broken, corrupt, too large government that we can't keep track of sensitive materials.

When it comes to politicians, the selective prosecution needs to stop. Party affiliation should not matter. If you break the law, you should be charged. Let a jury sort it out, not other politicians. The system is corrupt enough as is. We can't have politicians only answerable to themselves.

BTW I disagree about the conduct. The point in classifying documents is to see that they are properly stored and handled ... doesn't have anything to do with why someone believes he should be able to access or keep them at will or becomes belligerent when confronted.
The classification status of the documents is only one aspect of this case.

The point of the Presidential Records Act of 1978 is that these items, whether classified or not, were not the personal property of the former President. Per the Presidential Records Act, NARA has the discretionary authority to define what constitutes a presidential record, and they have the right to retrieve such a record that they believe to be in the possession of a former President.

Trump should have cooperated with NARA, and handed over the items upon their request. This whole thing was created by Trump's recalcitrant nature, and his egotistical reluctance to ever cooperate with any type of government oversight body. He is a profoundly stubborn person, and this causes him some easily avoidable problems. Very few Republicans are holding him accountable for the significant role he played in this indictment.

Guy who doesn’t know what “similarly situated” means thinks he has all the answers.

None of that post you replied to was based on information obtained from a news source. It was obtained from reading the indictment itself, and being familiar with what the Presidential Records Act of 1978 says ....

The other problem, even if you think someone could make the absurd argument that a President could take anything out the door with him, is that Trump is alleged to have said he knew he couldn't.

Lemme guess, RINO?

The way Trump's own former appointees and cabinet members talk about him is incredible ...

Attorney General William Barr
White House Chief of Staff John Kelly
White House Chief of Staff Mick Mulvaney
Secretary of State Rex Tillerson
Secretary of State Mike Pompeo
Secretary of Defense James Mattis

Apparently, everyone is a RINO or a Never Trumper. Everyone is wrong except for Trump - who is always the victim.

The indictment contains some counts which Trump is undeniably guilty of. Per his own lawyers, he hid documents which by his own admission, he knew he wasn't supposed to be in possession of, and he asked them to do the same.

What is your explanation for why he took so many and, more importantly, intentionally kept them when directed by authorities and even his own lawyers to return them?

Because he asserted his right as President to have declassified and kept them. Again, these aren’t MISSING docs, they inventoried them. They just disputed who could keep them.

Once this gets to SCOTUS it will be kaput just like with Bill Clinton but Dems don’t care because they know it will take awhile and this is all political theater.

Btw, none of these arguments are comparable to Biden’s mishandling of the docs - or Pence either for that matter. ONLY Presidents have those special rights.
