Gatlinburg Being Evacuated

Yes ---and since you say politicians are involved, now I can see where the incompetence comes from

It's not incompetence. There are a number of very good reasons that the NPS has changed their fire suppression policy in the last few decades. Like I said earlier, educate yourself on it before you criticize to harshly.

I'm not a lawyer but can minors be held financially responsible? Can the parents be financially responsible when their kids do something like this?

It's kind of pointless to go after a minor because they have no money. A judgment is worthless if you can't execute on something that can pay off the judgment.

The second question is more of a gray area. I mainly practice criminal defense, so it's not my area. Parents can be liable. However, I believe you have to show that the child's conduct was reasonably foreseeable (maybe prior misconduct) or they were negligent in their supervision.

Listened to the news tonight. I can understand why they dropped it. Very difficult to prove the fire the boys started was the one that did all the damage and took those lives since there were multiple fires. Also, they state doesn't have jurisdiction inside the park where the boys allegedly started the fire. They are not totally out of the woods yet. The feds could choose to prosecute the arson charges.

What about future earnings?

What about future earnings?

A judgment is only good for so long, but you can re-enroll it after a while. I can't recall how old the kids are, but you are looking at a minimum of 5-7 years of any decent earnings, and that's if they graduate with a college degree. Even then, they won't be making huge money. It's an exercise that most people and attorneys will not want to partake in.

Thanks for your insight.

So, what's the explanation for knowing the fires existed and the decision to let them burn 5 days prior???

Ulysees E. McGill can answer that ( I think)

This particular instance was a mistake in hindsight, but I'm assuming you have internet since you are on VN, so if you will do what I said earlier, and look it up, you will find out why their fire policies are what they are...just like I did. The reasoning behind them are not stupid. But the inflexibility shown in the Chimney Tops fire was stupid.

Ok then --- and I agree with the last sentence very much ---

I will say this, since this was not a naturally occurring fire, and because of the extremely dry conditions, and because it was in close proximity to populated areas...then the NPS did not really follow their proscribed guidelines with this particular fire. They should have suppressed it immediately. That was stupid.

Yes I looked it up and yes I agree with this post -- thats my reasoning all along -- Im not trying to argue about it

"The two boys, ages 17 and 15.."
"The two boys are friends and live in Anderson County, Tennessee."
"The oldest teen is the son of an Anderson County Sheriff's Office employee"

I've heard the explanation for why it allegedly wasn't put out was that the Chimney Tops were too steep

Ever ate there, Coug? Any good?

I have at the one in Pigeon Forge. I thought it was very good. If you go try the wedge salad. It has catalina and blue cheese on it and is delicious. I love blue cheese and would never choose catalina but both on this salad was great.
