Is Trump constitutionally barred from being POTUS again?

Sidebar on mid-century political conservatism: Barry Goldwater argued the limitations of Federal government, stating that all other powers were reserved for the states. Even though an election is for a Federal office, it is the right of states to conduct these as they see fit. If some states bar Trump from the general election ballot and others do not, all states will select presidential electors in accordance with their laws. These electors will cast their initial ballots in accordance with their state laws. If a president isn’t elected on the first ballot, that’s when matters get interesting.

So basically his name is removed for insurrection even tho he has never been charged with insurrection. I understand that is not in the verbiage of the amendment used, but I wonder why the amendments are in that order...like can a lower amendment override an earlier amendment. So basically Trump could are he is being denied his 5th amendment right of due process of insurrection charge for which he is being punished for.

Ok, I get your point. So my answer is IDK but I would think each amendment stands on it's own and is equal to all others.

To review: On Jan. 11, 2021, then President Trump was impeached. The charges included “incitement to insurrection.” Fifty-seven senators voted to convict. As Senate rules require 67 votes to convict, Trump was acquitted. The Senate trial extended beyond the President’s end of term. This was cited by a number of Senators not voting to convict.

On August 1, 2023, a federal grand jury voted to indict Trump. Charges include conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding. These are related to the prior charge of “incitement to insurrection.” These charges have yet to be adjudicated.

By the above, Trump hasn’t been convicted of incitement to insurrection.

Noted that the 14 amendment doesn’t require conviction.

i just can’t understand how you guys can make sense of abolishing democracy to save democracy. It makes no sense. There’s been zero due process in any of this. Trump has only been gaining support with every stupid move the left makes because it’s far too obvious that he’s just a political dissident being persecuted at this point.

This could be a long game play by the dems to gain traction in abolishing the electoral college..Trump wouldn't win Cali anyway....but between Co and Ca the Dems could claim that Trump didnt actually win because he could lose the popular vote for 10s of millions

Tim Pool said this last night. Would be smart. And since we don’t teach kids civics, it would be supported. People in smaller states all too happy to throw their vote away to five major cities.

Normally he has some pretty good take...I dismissed that theory till your post about CA...there is no danger of GOP winning CA. So whats the point?

Democrats would never lose again if we abolished the electoral college. It would be a long game strategy to sacrifice this year to trump, but use the optics of him losing by 10-20 million votes as a way to get rid of that system. Republicans would never win another election again after that.

it would require a USC Amendment and the odds of that are like 0.

Elections are state issues and each state has the power to decide who is eligible to be on their ballots.

I’m in support of states rights. This has nothing to do with democracy and Trump received due process in the CO courts.

So if states decided to remove Obama from the ballot in 2012 for killing American citizens without due process, you’d support that too?
 
Forget removing Biden. Remove any Dem candidate from any seat ballot. Easily disqualifed based on 10th alone.
