Yes he’ll be confirmed 52-48. Manchin will crossover and support the nomination. Wouldn’t be completely shocked if Donnelly supported him as well.

Flake has played both sides of the fence since last week but his play for the investigation paints him in a corner if he has future political ventures in mind.

So even if you figure that law profs are evenly split on agreeing with conservative vs liberal court ideology, if all the signers come from the liberal side it's still less than 8% of those that disagree with K's judicial philosophy. It's fringe anyway you slice it.

Unfortunately when you are basically employed by the USG, your personal life is and should be taken in account. Even employees at my level have their personal lives scrutinized.

I am fine with that. I just feel the professional record should weigh more.
