I believe they could try for a wrongful death suit. The problem is that the same evidence paraded out at the criminal trial will still be there, including pics/video/testimony showing the actions of the deceased.

True but a preponderance of the evidence is a much lower standard than beyond reasonable doubt. It’s like dropping from being 100% sure of something to being 51% sure and that being good enough.

How about this......
Of the two possibilities:
1. Innocent okay sign while posing with proud boys
2. White supremacy symbol while posing with proud boys.

How would you break it down? 50/50, 80/20, 20/80.
Just your best gut feeling, an estimation based on your opinion.
