Garland Sends Letter To Governor Abbott, Threatens Legal Action Over Migrant Executive Order

U.S. Attorney General Merrick Garland wrote a letter to Republican Governor of Texas Greg Abbott on Thursday in response to Abbott’s recent executive order.

According to the governor’s website, Abbott signed the executive order “restricting ground transportation of migrants who pose a risk of carrying COVID-19 into Texas communities.” It also “directed the Texas Department of Public Safety (DPS) to stop any vehicle upon reasonable suspicion of such violation and reroute such vehicles back to its point of origin or a port of entry. DPS also has the authority to impound a vehicle that violates the Executive Order.”

In response, Attorney General Garland wrote his own letter to Abbott, saying that the order cannot be enforced, and pressed the governor to immediately take it back.

He also stated that it “directly interferes with the implementation of federal immigration law.”

Garland concluded his letter by saying that if Abbott does not rescind the order, he was providing notice that “the United States intends to pursue all appropriate legal remedies to ensure that Texas does not interfere with the functions of the federal government.”

Justice Department Sues Texas over COVID-19 migrant transport order

The Justice Department filed a lawsuit on Friday against Texas Gov. Greg Abbott, seeking to block and strike down an executive order designed to limit the travel of illegal immigrants who may have COVID-19.

The filing, which states, "No State may obstruct the Federal Government in the discharge of its constitutional responsibilities," comes one day after Attorney General Merrick Garland urged Abbott to withdraw what he described as a "dangerous and unlawful" executive order, which the governor signed following reports of COVID-positive migrants being dropped off by Homeland Security Department officials in the border towns of La Joya and McAllen pending their U.S. immigration court proceedings.

Migrant detention facilities in West Texas, already exceeding capacity, were forced to close their doors to migrants on Saturday as they have exceeded the physical space to take in more. The increasing surge of migrants in the Del Rio Sector forced Border Patrol officials to resort to outdoor detention under the Del Rio International Bridge along the banks of the Rio Grande River.

The migrant surge in Del Rio brought hundreds of mostly Haitian and Venezuelan migrants entering the city illegally on a daily basis, Breitbart Texas reported. Border Patrol agents are met each morning by hundreds of migrants crossing the shallow Rio Grande near the bridge and surrendering to law enforcement officials. The vast numbers are crippling the Border Patrol’s ability to arrest, transport, and process the migrants efficiently and humanely.

Republicans have slammed President Joe Biden's handling of the border crisis after incredible drone images revealed up to 1,000 migrants being held by the Border Patrol in Mission, Texas, after they crossed into the U.S.

The footage shows hundreds of migrants stopped by Border Patrol agents sitting in a long queue under Anzalduas Bridge on the southern border between Mexico and the U.S.

The drone footage, which showed hundreds of migrants sat in large groups in the shade of the bridge, was posted by Fox news correspondent Bill Melugin.

He tweeted: 'This is the largest group of migrants we’ve ever seen being held by Border Patrol under Anzalduas Bridge in Mission, TX.

'Looks like it could be up to 1,000 people. We can only get a look at the area with our drone. There’s a popular Rio Grande crossing area nearby.'

Democratic Representative Henry Cuellar, from Texas, said that agents from the United States Department of Homeland Security as well as local communities living near the southern border are 'overwhelmed' by the influx of migrants at the southern border.

Cueller, who has written to Biden asking him to appoint a new 'czar' to tackle the surge of unaccompanied migrants, shared images of scores of migrants sat underneath Anzalduas Bridge at the weekend.

Cueller tweeted: 'Our DHS agents, & border communities, are overwhelmed & must be prioritized. DHS will again encounter over 180,000 immigrants at the southern border during July—adding to the more than 1M immigrants that have arrived at the southern border in FY21. Something has to change!'

Meanwhile, Republican Representative Chip Roy shared similar pictures and tweeted that Border Patrol agents are 'overwhelmed' as they running out of space to process the migrants.

The footage comes as Republican Governor Greg Abbot on Saturday claimed the Biden administration has caused a 'constitutional crisis' after the U.S. Justice Department sued Texas to prevent troopers from stopping cars carrying migrants.

U.S. officials reported this month that they had encountered 55,805 members of families with children in June, an increase of 25 per cent compared to the previous month. That figure still remains far below the high of 88,587 in May 2019.

He added: 'President Biden has a duty and a responsibility to protect and uphold our nation's sovereignty, yet he has long-since abdicated his authority to do so.'

The administration has faced pressure for months as the number of people arriving at the southern border hits historic highs.

On Tuesday, ICE Agents were denied authorization by the ICE Command Center in Washington, D.C. to arrest a felon released from a Texas prison after he completed a 30-month sentence for stealing more than 60 laptop computers. The denial effectively allowed the person to avoid deportation.

Speaking on the condition of anonymity, an ICE agent informed Breitbart Texas about the denial to arrest and process the foreign national for removal. The source adds that most of such calls to Washington end with negative responses.

The migrant was arrested by the Texas Department of Public Safety Criminal Investigations Division and Homeland Security Investigations (HSI) after a joint operation. The suspect was found to be a visa overstay and had no right to remain in the United States, according to the source.

The source relayed Washington’s justification, noting that he did not pose a danger to the general public.

Del Rio Sector Border Patrol agents arrested five migrants near Uvalde, Texas, who wore camouflage gear and attempted to avoid apprehension. Officials said they found property stolen during the burglary of a local ranch house.

Uvalde Station Border Patrol agents encountered a group of five migrants wearing camouflaged clothing near Uvalde. The ranch is located about 70 miles from the Texas-Mexico border.

Del Rio Sector officials reported the agents found the migrants carrying clothing, binoculars, and knives from a nearby ranch house they allegedly burgled. Local police responded to a call from the agents and arrested the five migrants under state laws.

A van full of suspected illegal immigrants crashed in South Texas, killing as many as 10 people and injuring at least 13, authorities said Wednesday.

The van had 30 people inside and veered off the road and crashed into a utility pole, Lt. Chris Olivarez with the Texas Department of Public Safety told Fox News.

The driver was also killed, he said.
