Seems like blame is now being focused on refiners rather than crude producers. You have to love this comment that shows some of the problem is business responding directly to what the current DC idiots in power want. It has looked all along like a refining issue considering the disparity between gasoline and diesel prices - if it were just available crude, the price increase should be more a mirror image.

In addition to the shutdown of refineries, at least two are set to be converted to biofuel production facilities, further shrinking the refining capacity available in the world’s largest oil consumer.

Big plants cost big money. Look at a dead nuclear industry - high cost, long lead time. Companies cannot expand without capital; investors demand quick return on investments - that's not a marriage made in heaven. If we ever hope to restart US industry, there will either have to be alternate ways of financing the construction, or tax laws on investing will have to take some real restructuring to take away the focus on short term reward. That may sound wrong, draconian, and socialistic; but the investment markets are killing investment.

IIRC @hog88 showed me where ships are not allowed to burn high sulphur diesel/oil anymore, they have to burn cleaner diesel, thus increasing the demand for more highly refined diesel even more.

Sulphur:

Sulphur in the fuel is one of the main factors for sulphur oxide pollution from ships – a pollutant which is currently under major scrutiny. As per MARPOL, the current sulphur value for HFO are:

• 3.50% m/m on and after 1 January 2012
• 0.50% m/m on and after 1 January 2020

IMO the tighter regulations on marine fuel and/or diesel puts more stress on processing capacity than on crude oil consumption. Low sulfur diesel requires more intensive hysrodesulfurization (HDS) which consumes hydrogen at high pressure and temperature across a catalytic reactor to break down the sulfur compounds. Probably does yield a bit less fuel per barrel of crude but it also creates new bottlenecks in the refining process.
