NTSB recommends ban on use of cell phones or texting while driving

Thankyou for your service, but the argument is of course fatally flawed because it depends on the absurd assumption that drivers will consciously think themselves so much safer because of a ban on cell phones that it causes them to change the way they drive.

That's just nonsense relative to this issue.

When you are talking on your phone while driving, what are you thinking? For me it is, "Ok, I don't want people to think I'm one of those inconsiderate jerks who can't talk and drive, so I need to be careful and drive safely."

Then when I'm done and I put the phone down I think "Ok, now to make up some time." and I hit the gas.

I bet everyone else does the same.
 
My kids hate when I'm on the phone. They say I'm a much slower driver while on the phone.

I have a theory that when the arm goes up to lift the phone to the ear, the accelerator foot comes up along with it.
I see it on the interstate all the time. Someone is driving with the pack and then slows for no reason other than they answer the cell phone.

I was going to say I'm on a hands free device but I still lift my are to answer the blue tooth so never mind. I do try to stay out of the fast lane though.

Nice! It is easy to tell who is on the phone or texting.

Of course it doesn't apply to everyone. There was a horrific case in York County last year where a woman was applying make up, talking on the phone and driving over the speed limit. She ran through a coned off area where the police were conducting an accident investigation and hit an officer while still accelerating. It was a tragedy that may have been avoided had she been paying attention.

The problem is you can't legislate common sense. After seeing how this woman reacted and her behavior during the trial, I suspect she would have found other ways to be a menace on the road regardless of whether she was allowed to use her phone or not.

It's hysterical that you all assume that talking on cell phones and driving will miraculously stop because there is suddenly a law against it.

Secondly, there are numerous legitimate reasons why someone might need to talk on the phone while driving but let's throw that out the window because a select few idiots don't know how to talk on the phone and drive appropriately.

Lastly, you all realize you are just giving cops another excuse to pull you over without having probable cause for anything right? "Gee officer why did you pull me over?" "Well I clearly saw you with the cell phone in your hand". Hello police state.

I've got to get in touch with my kids on their cell phones because they are waiting for me to pick them up at school and I'm not going to be able to make it there. Are you saying I need to pull over in a parking lot to make the phone call? That's retarded.
 
So will Traffic Enforcement Officers have to go through the subpoena or search warrant process to prove someone was actually using their phone just to issue a citatation?

Well there won't be any way to determine if you were actually using your phone or not. If they "think" you are even on it or using it, or maybe they will just lie because they want to pull you over.

No, they will pull you over and give you a ticket. If you want to claim you weren't using your phone, you can go to court and tell the judge.

No different than running a stop sign. There is no need for positive proof. Officer says you did and testifies, you say you didn't and testify, judge decides who he believes. Happens every day.

Let's say you convince the judge you weren't on the phone and the officer is mistaken. You'll have spent a half day dealing with the issue. Still has the effect of dissuading you from doing it next time.
