Gillespie had no contract with UK. He was terminated for a clear gap in how the rules and responsibilities overseeing the program were viewed. He walked away with a nice settlement.

Pearl was wrong, admitted it, and suffered the punishment set from the university. They are now wrongfully terminating him after he met all their demands.

Just playing the Pearl advocate here. Based on the evidence he should be fired - but it's not as easy as just telling him to pack his crap and get out.

I'm fairly certain that Gillespie had a "memorandum of understanding" that gave some sort of buyout or severance package. There's no evidence that that is the case here, and I'd be shocked if there is. What we do know is: Pearl's an at-will employee that can be fired at any time for any reason.

Maybe so. I can't imagine there is not some shread of documentation signed by both parties with so many agents and lawyers involved in contract proceedings to protect both parties.
 
Gillispie had a Memorandum of Understanding signed by all parties. Further, no court ever ruled on the merits of his claim. The parties settled. Pearl has squat.

I doubt Pearl would get to court for the same reasons. A settlement for the university would be much less painful and allow us to move on. It would all be dirty none the less.
 
He has agreed to work out of contract, not terminate himself, as of yet.

Terminating his contract was his termination. They tried to reach new terms and his suggested changes were not only dismissed, but left wholly unconsidered.

Since then, they've operated from a simple memo of understanding - which includes absolutely none of the guarantees and protections contained in either his previously executed (and which was terminated) or even the one which proposed (but was never executed), thereafter. While anyone can file suit (and the ample supply of attorneys who would bring such suit is no indication of successfully doing so, whatsoever), UTAD would spend less than $5k and one hearing in defending it.

Suing UT would be the absolute worst possible thing he could do, if not from a legal standpoint, than an occupational one. If you think he's got too much baggage to ever coach again as it is, throw "repaid last employer's attempts to stand by him by filing frivolous suit" and see if that helps his chances or not.

And finally, its difficult to imagine that he suddenly turns into the darling of the same media who have made every possible effort to crush and expose his misdeeds over the course of the last several months.

Whatever UT gives him in leaving will be to offer some reward for what he has accomplished durng his time here - but its completely discretionary in every sense of the word.

Add a win over Michigan and an upset against Duke, and this is the best possible way for the next 2-3 weeks to play out. A resignation that allows both to save face, a homerun new hire, and a summer not worried about sanctions.

What does it matter about sanctions since we will not be going to the dance anyway.
 
I think there are some valid points in the OP. I think, however, that we have Hamilton here for awhile and we have Pearl here after he sits out next year. The show/cause penalty can be horrible for Pearl if he's fired or resigned so if that happens, he isn't resigning for sure.

My take:
The best, most beautiful thing that has happened on Pearl's watch is the Jim Tressel thing. Now, you have the nation's most high profile program under the same fire. So, if you nail Pearl to the wall, you most certainly have to do the same to Tressel. And, folks, they won't.

Depends on who we hire. We don't have enough size or depth in the paint to contend for a national title, or anything, but there's no reason we shouldn't make it to the dance. We're not totally void of players.
 
Looks grim from roster, but let's at least see who's hired before tanking his first year.

Roster looks bad but I wasn't seeing 25 wins with the roster Buzz left either. Who knows what could unfold with the right guy and right style. Could be a disaster, or could surprise us the 2005 team did under a new coach. I am not writing the 2011 team off

Green was run off because he thought he was bigger than he was, thought he was UT bball. Sound familiar? O'Neill has only outcoached Pearl twice with a vastly inferior roster and half the depth, you do the math. People skills don't determine a coach. Anyone can have "people skills" when the camera is rolling. The BP off camera is quite diff than the BP on camera. BP is a shrew PR guy.

Actually his chances are 50/50 depending on what the 'AA decides and that's what hamilton meant. "The jury is out" means there is no new information and no decision has been made. So yeah, just incase you forgot how to read.
