Rae Burrell Update from Kellie

The reason we know so little....Unless an individual gives permission for their medical info to be released to anyone, other than the individual, or those so designated, it is a big no way man.

HIPAA very well could apply in this context if her care providers are covered entities. If they aren’t, then FERPA does still apply, and any release of medical information by the University or a University representative (staff member, coach, trainer, etc.) which wasn’t authorized by the student athlete most certainly is illegal!
Medical information would not qualify as educational records, so no, FERPA would not apply either.
th

Pretty sure the institution (coaches and staff) has simply been directed by the AD to stay out of the dissemination of medical information business, period.

In my opinion, this is as it should be. We, as fans, have no need to know about the details of their condition if a player doesn’t want to release such information.

Both statements you made are incorrect. I am a health care provider (ophthalmologist). I understand HIPAA very well and it does not apply in this context. If Rae told her coaches/teammates and they shared the information that would not be a HIPAA violation.

If she told the athletic trainer/physical therapist and they shared the information…That would be a HIPAA violation.

FERPA applies only to academic records. Mainly so that parents/potential employers cannot access student information without their consent. Has no application regarding student health issues. Though if a student were seen at a student health center both HIPAA and FERPA rules may apply to those documents.

It's not about wanting the "player's" information, . . . It's about a fan planning on going to the game wanting to know that if they are making the trip, asking for a day off, etc,,,, taking great measures to see the game,,,is the one that was on everybody's watch list,,,,, playing!?

It's not about the player, it's about the expected product/players.

Are they winning. Yes and they will continue to do so.

But to this point we haven't needed too many of the players to do what Rae has/can do...."put the team on their shoulders" and carry it for an extended time...most of our wins weren't in severe jeopardy.

Yes, fans love to see all players win in orange
I do too
but I also like to watch RAE shoot sweet jump-shot with a near perfect release,,, her long range bombs and her much better technique on driving and finishing at the rim also.

With respect, the staff has provided information concerning the availability of Rae Burrell. This answers your issue of the fans' "planning on going to the game wanting to know that if they are making the trip, asking for a day off, etc,,,, taking great measures to see the game,,,is the one that was on everybody's watch list,,,,, playing!?". Any specific knowledge of Rae's specific physical condition is unnecessary to that issue and a matter of Rae's privacy. And, further, as it relates to all of the earlier discussion of HIPAA and FERPA, regardless of the applicability of those laws, if a player tells the coaching staff that they wish the exact information to remain private, any staff with an ounce of moral scruples might try to change the player's mind, but if that was unsuccessful, they would honor the player's request in my opinion.

Sorry, but it is about wanting information that is protected.

I'll add this to the above..HIPPA can be complicated. HIPPA doesn't apply unless the physician is billing insurance (ex.if they use an in house Doctor HIPPA doesn't apply) . Even then, though, most universities get athletes to waive hippa rights as a condition of participating. I've noticed this year certain conferences or maybe it's just schools seem to be treating the release of information differently. I've seen more cases like Rae's where schools give very little info.

I just hope her injury is one that heals without future issues.

kelly could say we and docotors and rae think she could be around jan 15 if theres no sit back her leg is about 60 to 70 better she could give a update every week or so about time frame and leave what kind of knee or other part of her thats injury leg

CKH did indeed give out info on Rae ( it's not an ACL injury). So you HIPAA experts can explain the "pick-and-choose" methodology here...give out the good and hold back the rest. Apparently fans are entitled to the news that suits the UTAD.

Fans are not entitled to information about a young woman's medical problems, good or bad. Give it a rest.

Entitled is probably not the right word - how about "worthy"? As in we were worthy to get Suarez's injury status in full. Rehab outllook, recovery period - all of it.

Jimmy Hyams even pontificated on all this, and surmised that "UT's seemingly day-to-day status given to Rae Burrell doesn't fly after 30-40 days," and theorized that she must be hurt more than they're willing to let on. Said it today - smack in the middle of Early Signing Day.

Rae swished baskets from the 3 pt line at Blacksburg, so of course many people think she's coming back soon. But there's also talk she may be out for the season. Just throw us a bone, fcol. UTAD doesn't have to tell us - but they should want to. We're good people...

Getting panties or briefs in a tizzie is a waste of time worrying. Whether we know or not doesn't matter, Rae returns when she does. Sure it sucks not knowing, but this back and forth is frustrating. I keep seeing uptrend thinking for news but nope it's back and forth like any political thread.

VolBalls33, same here. I keep clicking on the thread when I see there's a fresh post, only to see it's just another nothing burger.

It would please me to no end if nothing whatsoever was said about Rae until she is cleared to play. There's no point in all this back and forth about it, 'cause nothing said here will get her back even one nanosecond before she's ready. The false alarms are wearing my nerves out! o_O

Progression sounds good

This jibes with the 6 week recovery timeline of a dislocated patella with no ligament damage. When Burrell went up for a shot she said she heard a pop. That may have been the sound a knee cap popping out. The knee cap then either slid back into place naturally or was popped back in by the medical staff. This is pure speculation on my part but I believe this is what happened.
