Whyy would there be a civil suit & not a criminal suit?
Seems like if there's enough evidence for this then there'd be enough evidence to convict. Even if its consenual, he's and adult, she's a minor. It's statutory.

could be wrong but in matter of Statutory, I dont think the State asks permission to press charges. it just is what it is.Totally different burdens of proof, and anyone can file a civil suit. While the standard for an arrest is probable cause, the criminal burden is the highest burden of proof in our country. It is not unusual for someone to sue without criminal charges.

Just read article on ESPN, saying that he along with two other defendants are still under an ongoing criminal investigation on behalf of the University. And, that he neglected to tell the Bills when he was drafted. Bills concluded its own investigation then released him.The state (or government) always has to initiate criminal charges. It also depends on that specific state law, but in TN, the defendant has to be at least 4 years older than the victim to qualify under the statutory rape statute. So, a person who is 19 and a victim, who is 17, does not qualify as a crime.
