Whyy would there be a civil suit & not a criminal suit?

Seems like if there's enough evidence for this then there'd be enough evidence to convict. Even if its consenual, he's and adult, she's a minor. It's statutory.

Totally different burdens of proof, and anyone can file a civil suit. While the standard for an arrest is probable cause, the criminal burden is the highest burden of proof in our country. It is not unusual for someone to sue without criminal charges.

He was suggesting the possibility. It's a high standard of comparison. Hyperbole is easily misinterpreted. I think there are more posts but am not going to look for them now. He could have said Andy Kelly didn't have a strong arm, but chose to put Baily in the Montana/Manning set or league as it were. To me this a suggestion of calibre. I think he has me on ignore too so I will just drop it unless he shows up as an intervenor and real party of interest.
Clearly in response to the legend of Milton's arm. Stronger than Hendan's and we see how important that ended up.

could be wrong but in matter of Statutory, I dont think the State asks permission to press charges. it just is what it is.

The state (or government) always has to initiate criminal charges. It also depends on that specific state law, but in TN, the defendant has to be at least 4 years older than the victim to qualify under the statutory rape statute. So, a person who is 19 and a victim, who is 17, does not qualify as a crime (as long it is consensual).

Just read article on ESPN, saying that he along with two other defendants are still under an ongoing criminal investigation on behalf of the University. And, that he neglected to tell the Bills when he was drafted. Bills concluded its own investigation then released him.

He was 21, she was 17. which is 4 years.

Incident occured at his residence, over 1 hour and 30 minutes of time elapsed during her gang rape. Unreal.

I’m just trying to explain the law- not explain it away. No one knows the real facts from witnesses except for officers who are investigating it. They will determine if they have enough proof to charge it.

He already admitted that he had sex with the girl. That’s rape in California alone. He is innocent until proven guilty but you can’t have him on a roster when the cops have a phone call of him saying he had sex with a 17 year old girl
