Ding ding ding! We have a winner. All the board can do is try to delay until they find a counter offer of equal or higher value. If they chose less money to avoid selling to Musk then Musk and other stock holders will sue. And win.If they can’t find another person or group to outbid him, they’ll probably have to sell to him. Any business that sells equity to raise funds has a fiduciary duty to act in the best interest of its shareholders. They could open themselves up to lawsuits if they reject the offer and the stock tanks.

The man is clearly very intelligent and creative, but he has a bad habit of not thinking through some of his more outlandish statements.
