The problem obviously is the question of how the state protects a freedom that people can't even agree exists. Is there anywhere other than pursuit of happiness in the US Constitution that remotely would address gay marriage. Maybe the part about all other issues being addresses by the states.
This whole notion that certain freedoms don't exist unless they were included in some old document is silly to me. The constitution doesn't award us rights, it protects them. Our humanity is the nature of our rights, IMO. We are free to do whatever we want, so long as it doesn't directly hurt others. That is the general sentiment of the constitution, even if gay marriage wasn't a question at the time.
