Harrier Miers, as the only single member council anywhere, should have been nominated.

I'm afraid Obama might nominate himself, being a constitutional scholar and all. Did you know he actually taught law?

Souter is once again going to have a major affect on the balance of the court. Looks like BO might get 3 shots at restructuring the court to fit his view of "economic and social justice" and government control.

This is depressing.

The defection of Specter looms large here. Isn't he ranking member (or wasn't he) on the Judicial Committee?

Does anyone know if they have to remake the committee to add another R seat since one of the R seats is now a D?

This will be interesting. A certain percentage of the Republican Senators will oppose the nomination, no matter who it is. But, with opinion polls showing the Republican members of Congress increasingly viewed as partisan obstructionists, you may see a number of them keep their heads down as long as its someone not way off the reservation.

This didn't stop Dem's with regard to judicial appointments.

I think the R's have a legit position of obstruction if the appointee isn't about as "moderate" as Souter. I would imagine there are enough Independents and Moderate Ds to be concerned about true 1 party rule. So long as they frame their dissent along these lines I think they'll be fine.

if he tries to appoint a Justice that views the Constitution in the same way he does we might as well tear it up and start over. Unfortunately he's going to have up to 3 shots at this so I hope people pay attention in 2010.

It will be interesting to see how BO reacts to any R's that oppose his nominations since he still stands by his opposition to Roberts and Alito (one of the few senators who vote against confirmation).

I believe he felt advise and consent was a very high bar - I bet he changes his tune as POTUS.

hussein is going to nominate a true leftist. heck i'm sure he'd nominate Marx himself if he were alive and living in SF. if hussein nominates a leftist. you'll see some the few conservative to moderate dems start sweating. do they want to vote for a judge like that dude from Indian who thinks you should not pray in Jesus' name but can pray to allah. that is the kind of guy "the muslim" will nominate.

Most people also believe that Republican leaders have not clearly articulated their opposition to Obama's economic policies. While 54% of Americans say that Obama has clearly explained his policies, just 25% say that Republicans in Congress have clearly explained why they oppose his approach. Even among Republicans themselves, as many say their party's leaders have failed to clearly articulate their position (42%) as say they have explained themselves clearly (41%).
