"Beard was booked into jail at 4:18 a.m. Monday, according to the Travis County sheriff's office jail records. Beard, 49, faces a third-degree felony charge of assault on a family/household member-impede breath circulation. "
Sounds like it was choking/strangulation.
sadly, that is common with DV victims. I'd guess for charges to be filed so quickly, they have something. I'm far from a legal expert, but I don't think his fiance not wanting to press charges means he would be off the hook. I think criminal charges/prosecutions/etc are up to the DA.I wouldn't be so quick on that. Some of what I have read says fiancée doesn't want to press charges. He's hired a top flight Austin attorney. I am sure fiancée will lie her ass off to save him. Just my guess.
I'm just curious about this. If he was choking her enough for this to be an "immediate dispatch" situation, how did she call the police?sadly, that is common with DV victims. all good questions, and you are right on about hoping one of his (or her) children didn't witness this. I grew up seeing some stuff like this at a young age. It's horrific to see as a child.I'm just curious about this. If he was choking her enough for this to be an "immediate dispatch" situation, how did she call the police?
His attorney lists her as the "complainant" (though I suppose that legal BS so he doesn't have to call her "victim") so it sounds like she called.
If someone else was there and called, there's more witnesses than just he said, she said. I certainly hope a young kid isn't going to get stuck in all this.
Seriously, if it was just the two of them and one's busy being choked out and the other is busy doing the choking...... who called the police?
There's an entertaining discussion on Surly Horns and a video of some kind of hearing with Coach Beard. The sound sucked so I didn't bother but legal types here might find it productive.all good questions, and you are right on about hoping one of his (or her) children didn't witness this.
