Depends on where the offense occurred, of course, the mere existence of the photos (if true) could be problematic as well even if it took place in another jurisdiction. If it took place in the State, they could have jurisdiction to prosecute, there might other ways a State can prosecute outside of the State. The issue with some of this is, statute of limitations depending on the charge. Hunter could have been prosecuted years ago by various States.
