The batter is out because he interfered with the catchers throw.

If the batter interferes with the play at home, interference is called and the runner is out. If a runner is attempting to advance to any other base, the batter is out and the runner is returned to their last legally occupied base. NOTE: if the defense successfully puts out the runner, interference is ignored.

So he should go back to first.
