If you are given a project to run and too little funding/resources, how do you do it? If you are given control of a project and explicitly directed to do it in a certain manner, then you are directed how to do the job rather than delegated a job to perform. We have three branches of government; the administrative branch is not subservient to the legislative branch ... that's not how it works. It is not the scope of congress to direct how the administration functions in detail.

It is within the scope of the legislative branch (specifically the House of Representatives) to appropriate the spending of taxpayer funds. That is what is most germane to this issue.

There was a time when we called that an "unfunded mandate". The law says to do something but the people responsible for appropriations don't provide adequate funding to do the job or do it properly. It's a coward's way of bypassing a law rather than face the rather unpleasant process of changing the law (or Constitution) to something people don't want. We either enforce laws including illegal immigration or we are lawless; we don't get to pick and choose which laws we can obey and neither should congress ... particularly when congress is in the business of writing law.
