I think you're assuming too much when you say it won't hold up. The conservative justices are no less motivated by partisan ideology than the liberal ones.because cancer surgery wasn't illegal in TN. what's been floated is the idea of preventing a state citizen from going elsewhere to do something illegal in said state. won't hold up but doesn't mean that it hasn't already been considered.
If any republicans had any foresight, they'd realize they just opened the doors to lose midterms and state elections.
Right to privacy was the argument used for the Roe V. Wade decision, right? I've always been of the opinion the 10th Amendment should take precedence and it should be a state issue, not a federal one. That does not mean I think states should be outlawing abortion. If a state makes an unpopular decision, it is up to the constituents of that state to vote for new government that will enact their wishes.Had to with right to privacy which while not expressed in that term exactly, exists in for example the right to be secure in your person or home.
