it's an unfair tax being levied against the smaller growers to penalize them and is fully supported by the gov't. Seriously, do you think this truly needs an ad campaign supported by the gov't for people to know live trees are an option?

Its not a responsibility, but the flaw in your remark is that its not a regulation on someone and so is not going to run afoul of anything. If someone challenged it, I suppose commerce clause would be used to defend it.

Also, unless I am mistaken, these other similar programs have been around for years, i.e. during Republican administrations. No one *****ed then. But, hey, if the knee jerk anti-Obama echo chamber can make it look like it was all his idea, then go for it.
