This is CNN ( before they sold their souls ) with Wolf Blitzer and another liberal talking about Biden being racist , making racist remarks in South Carolina, pandering to a room of black folks and how wrong it was for him to do it . Iā€™ve posted 5 videos of Biden now being racist and heaping praises on racist people / groups . My question is , are none of you outspoken liberals going to address the 800 pound gorilla in the room ? You can only hide for so long before you say Trump is a racist again and I call you out for not addressing the one you are going to vote for in these videos . šŸ˜Š

Strategy is very clear now. Call filling a vacancy to an opening in the nine member court ā€œcourt packingā€ and ā€œunconstitutional.ā€ Neither of which are actually true, but it will provide excellent cover when they actually unconstitutionally court pack in 2021.

They usually accuse the opposition of doing what they actually do. Same as with the Russian collusion deal.

How would it be unconstitutional to pack the court in 2021? Inappropriate, maybe, but I don't know why it would be unconstitutional.

You are correct that packing the court would not be unconstitutional. But nominating/confirming a Justice isnā€™t either. But now Joe Biden and his campaign are claiming that it is unconstitutional for Barrett to be confirmed which will provide cover for them once they decide to pack the court. They will claim to be righting an unconstitutional wrong with an action that is actually equally constitutional. So, itā€™s actually a question of appropriateness. And I would argue that filling a vacant seat under the normal constitutionally derived process (even in an election year) is much more appropriate than adding members to the SC just because they didnā€™t like who appointed 3 of the 9.
