It's obvious if you watch the video that this dude has serious emotional issues. He's a sick person, being punished for breaking an unjust law. And on top of that, the penalty is absurd.

He violated probation twice. No matter what you think of the law, dude is a dumbass.

It's not unfair. It's the same thing with every drug addict, "I want to get clean, blah blah blah." Very few actually take advantage of the various alternative adjudication methods. It's a shame, and everyone wants addicts to get clean, but after a while excuses just fall on deaf ears. (I am by no means saying I agree with any or all US drug laws).

They both require a conscious decision, but I really don't see how that refutes addiction as a disease. Both herpes and addiction start with a foolish string of decisions. That doesn't change what the end product is.

Rehab, detoxing, and dependence therapy exist because?

Kick a romance with opium and then say it's a simple matter of "up and quitting." You also have to factor that most addictions stick with someone for a lifetime.
