This is 100% a training issue. This dumbass in no way should've kept his knee there when the guy finally quits fighting him.

This officer deserves to be fired and sued off his a**....positional asphyxiation is even more likely when the suspect is on drugs as he was....
You didn't mention anything about jail time...

Depends on the type of claim and insurance. The individual officers may or may not be covered. And when it comes to a civil rights violation, suing the agency or city is very complicated. Plus the state may have laws capping the award.

Many moving parts to this.

I was speaking more towards "wrongful death" than civil rights.

Again, the individual officers may not be covered. And state law might limit the recovery.

Trust me, the lawyers who take on these high profile cases get on tv, but they don't swoop in and actually work it where they find out their fee is capped at something minimal.

This is an over policing over aggression issue.
That cop has issues..... not sure what they are, but what he did was criminally psychotic. I understand the man resisted, but he was already in handcuffs when the cop put his knee on his neck. How difficult would it have been to put him in the car after he was subdued? ...... but no..... the cop chose to punish him to try and prove a point and ended up killing him.

And to elaborate further, the reason they want to bring it as a civil rights claim is that the federal statute awards fees on top of damages.

this is true and I’m not sure what the answer is..... several years ago.... I had a red trans am with silver ground effects..... I was speeding doing about 90.... cops on other side of highway turned on their lights as they passed.... I decided to run from them thinking that they couldn’t get turned around in time to catch me .... I turned down streets trying to escape..... I pulled down this one street and their was what appeared to be almost 500 African-Americans outside.... two cop cars pulled in behind me and made me get out of the car.....a black teenager asked me what did you do? The cops drawer their weapons and told everyone to stay the f back.... I could tell those two cops were scared to freaking death down there in that neighbor.... Anyone made a wrong move and it was going down...

I don’t care what color the cop or the deceased man are, this is horrible. There was absolutely no reason to continue leaning on the man and the other office never even bothered to see what was going on. Realistically, I doubt the crowd control cop gets nailed with any charges but I could be wrong. The killer cop is screwed and deservedly so. It would be nice if we could just deal with the fact that a cop unnecessarily killed a man but I know that isn’t the way this will go. Instead, it will be about a WHITE cop killing a BLACK man. That’s what I hate about this ****. If that was a black cop that killed a white man the same way we wouldn’t even hear about it and it would be no less tragic.

Exactly.... what’s he going to do? Maybe some kind of Jackie Chan crazy ass Kung fu running up the wall flipping thing where he gets the cuffs in front of him..... and then applies a rear naked choke to the two cops?

Depending on the state, that could be on the table anyway couldn’t it? I know some states have “loser pays” laws. Not many but more should as it would keep some frivolous suits from occurring.

The cop should get his due process like everyone but I can’t imagine there’s anything he could say that will help his cause. He just needs to man up, admit he f’d up, apologize, and prepare to be someone’s bitch.

Possible. This was in Minnesota? Ill check tomorrow.

But it would be unusual to grant fees against government agencies as a matter of course.

It really does appear to be indefensible

He was wrong and should be held accountable. It’s not racial it’s the effect of repeatedly dealing with the same scum on a daily basis and letting emotions overcome rational thought in a heated moment.
