Defense attorneys in Gray case call for state's attorney to be recused | Fox News

Defense attorneys representing six Baltimore police officers charged in the death of Freddie Gray filed a motion Friday to have the case dismissed, or for the city’s top prosecutor to be recused from the case and replaced by a special prosecutor, citing alleged conflict of interest.

The filing also cites a pending motion against her office, her office’s role in investigating the case and Mosby’s personal relationships with potential witnesses as reasons she should be recused from the case.

The defense also argues that Mosby denied the officers their right to due process by using inciting rhetoric when announcing the charges last week. Mosby told protesters: “I heard your call for ‘no justice no peace.’ Your peace is sincerely needed as I work to deliver justice on behalf of this young man…You’re at the forefront of this cause and as young people, our time is now.”

LG or SDV, any thoughts on the validity of this?
 
The city has seen 40 shootings since April 28, the day after the city’s most intense day of rioting, including 10 on Thursday alone. There also have been 15 homicides in that span, bringing the year’s total to 82 — 20 more than at the same time last year.
One city leader said he doesn’t believe officers are treading too cautiously on the job, but he acknowledged that the stress from protests, rioting and federal investigations is wearing on police, as is fatigue for officers who worked 14- and 15-hour days several days in a row during the unrest.
“You have a perfect storm,” City Councilman Brandon M. Scott said. “First of all, I think everyone is tired. But you also have to realize for everything that’s going on in the city last week, we still have a violence problem in the city, and it’s just being exacerbated by the light being shined on Baltimore.”
Scott said he doesn’t believe officers are being “purposefully hesitant.”

I do not think it likely to be granted. Under their theory, no one married to another politician can ever be a prosecutor because, inevitably, the spouse will be called upon to weigh in on something controversial.

This seems to me like a motion designed to try to lay the groundwork for the notion that she rushed to judgment to calm the riots and to address political fears. The defense will hire experts on the medicine, in particular, and they will offer all sorts of alternative causation theories. Them the defense will put on a case that accuses the prosecution of acting with a political agenda.

I have to say, in that respect, the announcement of charges within one day of getting the investigation, and I believe the same day they got the autopsy report, was pretty poor decision-making by the prosecutor. I really think that is a function of her inexperience and the pressure to act. The defense will have a lot to work with based on this.

You think they get a change of venue? There is no way they get a fair trial within city limits.

I know its in the title of the youtube thread, but did anyone notice during the news reporting that the races of the victim nor the attacker were mentioned?

Had this played out the other way around what is the likelihood that race would be mentioned?

Like being an anarchist is a bad thing. Sheez

It is when you need help. You realize there was a reason people banded together beyond their family groups and formed governments? Complain all you want about our current government but no government is dumb as can be.
