No it's not asinine. It's a completely legitimate position to take, and it's probably the right position to take.

Either way, if it is a legal arrest, it doesn't make it a useful arrest.

75 bad arrests per day. What does the average bad arrest cost the tax payer? A few thousand $? So maybe $200k per day spent on bad arrests? What about the social cost? The cost to the individual falsely arrested? This is outrageous. Everybody should be against this.

I'm all for fixing bad policing so get your panties out of a wad. If this arrest is ultimately ruled illegal we might as well throw open the prison gates as many both violent and non-violent will have grounds for appeal.

A false arrest doesn't absolve you of unrelated crimes, so I think your worry about appeals is unfounded.

Maybe LG could weight in here. I'm sure there would be a bunch of cases where evidence collected due to the "false" arrest was used to convict.

This is what you don't get. Gray runs. OK, the cops think they have PC so they follow. Once they get him and find out they have nothing on him, why do they pursue charges? That's when the bad arrest happens. It's not in the act of searching him.

You're talking about guys who are caught and then found with concealed guns or cocaine, etc. He is not that guy. If they found that stuff on him, it would not be considered a bad arrest. They found a legal knife.

You said a moment ago that the police thought they had probable cause when he ran from them, not something I think either one of us believes, and thus once they persued and caught him they ran his info. When it comes back with warrants they have to arrest him. Cops should not have persued him. Once they did, and he came back with warrants, they have to arrest him. Would have been nice if they had you know not killed him and all.

As I understand it, they didn't run his info. They didn't know he had a warrant when they arrested him. They were just rounding up people in the meat wagon, like they do 75 times a day.

I bet they knew who he was/is.

If he was recognized and a officer knew there was a warrant, that's all that was needed

We had violent storms in Oklahoma last night and the news just showed a CVS that was damaged from some flying debris.

But I didn't see it looted. Just the sign damaged.


Remember Katrina.. Natural distaster.. Sorry Bush's fault.. Looting everywhere..... Hmmmmmmm

uhm, how is this Obama's fault? i don't like the guy or his politics but unless he said something i missed how is this round of shooting his fault. Baltimore is a bad bad city, Obama has next to nothing to do with it. this is all on the city.

Dang I wish I could empathize but my privilege prevents me from doing so. Oh well, back to collecting my ridiculous government salary. :rock:
