By "non-felony murder" I meant either 1st or 2nd degree murder.
I clearly need to stop counting on the intelligence of other posters.
Of course you would have still been wrong. 2nd degree murder could not have been considered. And, way to be on top of things by stating that the jury could consider 1st degree murder. No one would have been able to figure that out since it was only the top count in the indictment.
