I went back to work today. Several of us went to lunch and got into a discussion about Biden and apparent decline in cognitive ability if not dementia. Many said they voted for him but are now concerned.

I empathized with them eventhough I couldn't imagine the embarrassment they were feeling.

Lol. You act like this is a big deal. Rich people have always engaged in tax evasion of some sort. Itā€™s how they stay rich. You think Bezos, Zuckerberg, Buffet, Gates, Musk, Allen and Oprah stay within the tax laws? Please.
 
Did he file and since he was claiming to not be a resident got a refund? I remember one of the DAs complaints was about fraudulent refunds.

Taking the indictment at face value, he did not file NYC returns from 2005 to 2012 while he worked in NYC and lived at the apartment in question (although he maintained a residence outside the city). He clearly had a NYC filing obligation for these years. The fact there is no statute of limitations for these years will be troublesome for him.

Taking the indictment st face value, the rent, utilities, and garage payments should have been included in his taxable income. For long term situations such as this, the rent is not taxable to the employee unless ALL the following are true:

1. Real estate is owned by the Company
2. Its a term of employment
3. Its for the convenience of the employer

An example of this may be a church owns a house adjacent to the church for the pastor. This fact pattern does not exist if you take indictment at face value.

Obviously, he has the right to defend himself against these allegations and he may submit evidence that contradicts some of the findings.

There's a difference. Those billionaires that you referenced take advantage of the tax system, which is 100% legal. Taking the indictment at face value, the Trump CFO blatantly and illegally evaded taxation. Tax planning is legal. Tax evasion is not.

You really think those guys I listed are all honest and they are not hiding a ton of money from the IRS? I personally know someone who owns a company that does roughly $100 million in sales. He has money in different countries. He hides millions from the IRS. He makes pennies compared to the guys I listed.

And I know many others that will use every LEGAL method possible to reduce taxes and some with companies much larger than the one you referenced. In the gray areas of the tax law, they will push the envelope some; however, not 1 of them is evading taxes by not filing returns like the Trump CFO. Not filing a return isn't a gray area, it's 100% illegal.

Take the political blinders off and read the indictment. This isn't pushing the envelope. This is way beyond that. Obviously, this investigation is political and wouldn't be done against any other company but that doesn't change the fact that this is highly illegal.

Really, that's your touchstone? So, to be consistent, I guess your view is petty crimes committed by black kids shouldn't be prosecuted because the costs are higher than the crimes.

This is the same lady who campaigned on the idea of going after trump. She didnā€™t know what for, just that she was going to get him. So I imagine this is complete nonsense

You have to think that this would such obvious low hanging fruit that they would of had this 5 years ago.
 
If Weisselberg or Trump Co are victims of a political witch hunt, thereā€™s a selective prosecution defense that they can plead in court.
