I still haven’t seen enough to make me think he should be prosecuted, but I disagree that there are no significant differences.

Government thinking Hillary did a crime but not sure they can prove it because her story is plausible and consistent and her team seems competent enough to convince a jury is significantly different from government thinking Trump did a crime and he floating new defenses and keeps blurting out things that undermine all the defenses the government might worry about.

Also, still having the records when they bust in with a warrant after dickering for over a year and certifying that you complied with a subpoena is significantly different than “my team screwed up their review and deleted some things that were relevant.” At least it is significantly different with respect to intent and culpability. But that’s the fig leaf that Hillary used.

This op-ed is a fairly mature restatement of why Hillary’s situation is relevant, but as a defense of Trump, it is no more compelling than the GOP twitter account that ignored all the folders and pointed out the Time magazine.

IMO, the last remaining hurdle is the significance of the information breach. People making up stupid false binary choices for why it couldn’t have been significant notwithstanding, we don’t really know what was there and likely won’t ever know. Things marked TS/SCI seems bad, but I don’t really have a frame of reference for what that means, and, for me, that’s a significant element of a prosecution decision against a former and potential future president, even if I think he’s a piece of ****.

Generally agree. I mostly agree with the fact that the standard had been set, despite differences. The shear quantity of information Hillary had is staggering in comparison. And the fact that she was communicating classified information through unsecured/unapproved means, while traveling around the world making it accessible to foreign hacking. And the Hillary FBI report clearly states that although they found nothing, it was highly likely that where she was when sending these emails the information was seen by foreign entities. Regardless of any other fact, as far as I know, there is no evidence that the trump material was obtained or in that significant danger.

Again, both are/were wrong. One had a FBI director tell the DOJ not to prosecute. The other….

From the raid?? I know he handed over a bunch in January, but the raid didn’t turn ip that much from what I’ve seen. From what Hillary turned over (that was recoverable and not deleted), there were over 2000 classified emails.

Don't care who packed it that is just the way the Law works. Why didn't he return them when he found them? Why did he hide them from his lawyers? Why did he demand that the DOJ/FBI return his documents to Him?

Second, one would think if you have documents that belong NARA or anywhere else. I have no idea why he hadn't returned them and neither do you. We don't know behind the scenes what's been going on. You mean to tell me this took 18 months to discover? Also, this is historic.

We've heard about documents others have heard and nothing was ever done like this. Do you know what those records were? No you don't. Why not? Because the DOJ and FBI wasn't used against them. This is all meant to trigger people like you who get offended. You should be offended by the witch hunt.

Watching or Following it? So are you uniformed? Would explain some of your Posts. The Facts are pretty cut and dry.
The requests for those documents by the NA and DOJ began last year. Again, just simple facts.
The Classification of the documents is significant but does not change the crime he committed.
It did not take 18 months to discover, it took 18 months to provide the evidence needed to cease.
Other things going on in that 18 months between legal teams and Trump.
I am not triggered at all by this. We all heard about other incidents and I guess Trump maybe the first to be charged with a crime. Furthermore, what is your explanation for why others were not prosecuted?
