No. You should invalidate them because they are some combination of overreaching, outdated, or absurdly stupid.
I can only assume laws regarding the maintenance of governance documents which have been in your control in your capacity as a government official is one of those laws you think are overreaching, outdated, and absurdly stupid laws.
 
Every crime involves an actus reus (guilty act) like housing your classified emails on a private server in your home; and a mens rea (guilty mind) like intent to use said private server in order to advance some criminal purpose. The government needs to prove both to convict you of a crime.

In a lot of the examples being thrown around in here, the mens rea cannot be proven. I’m more than a little skeptical that there’s a federal crime involving erroneous tax returns that doesn’t require fraudulent intent. In fact, I think I remember reading or hearing about that specifically during the Manafort trial that they could have gone after him with civil claims to retrieve the owed taxes but that extra elements were added by the decision to proceed with criminal claims.

Also, according to Comey the evidence against Hillary did not establish criminal intent, the mens rea.

One other example: inability to prove criminal intent was also the conclusion of the Mueller report regarding many of the instances of possible obstruction of justice that were investigated.

I think that is correct. Intentionally trying to defraud the government = “we can send you to jail.” Being careless or of insufficient aptitude to correctly complete the form = “we can sue you to get back what you owe.”

I’m not a tax lawyer, don’t know that for an absolute certainty, but it makes sense and fits with what I remember reading about Manafort.
 
BB, and I mean this without disrespect, you either have not lived very long or led a sheltered life from the not-so-pretty-side of the world. You do not want to get in the cross-hairs of people with the power of the government behind them. Our system is fairly good; in fact compared to the rest of the world, our Bill of Rights is Second to none. But injustice still happens. Prosecutors, bureaucrats can decide to take a dislike to you and make your life a living hell and break you financially.

The criminal justice system is not much more than an industry currently designed to "manage" the problem: not let it get too big, but essentially "farm" a segment of the population so they have plenty to harvest.

Again, I have not meant this in any way to demean or belittle you, but I think your statement indicates a certain level of naivety.

And court costs and endless probing of orifices to determine whether it was intentional or careless. I imagine there’s an “okay, my bad, how much do I owe?” Lane that’s somewhat less painful.

I hear they’re hiring, maybe I’ll go sign up and let everybody know what I find out.

There was an investigation that concluded in Summer 2016, July if I remember correctly. They started a second investigation in late October.

I remember it well. And both investigations being vociferously defended on this board.

What if you were investigated because I accused you of being a phony? You knew you weren't a phony but I made it up. Would this be fair? Should you have to defend this lie?

I would lawyer up and plead the Fifth, just like Trump did. Just like everyone should do if law enforcement and especially a District Attorney try to talk to you.

I said in another post Trump absolutely made the right move. I'll never drag a person for taking the Fifth or seeking counsel. That is our right, and everyone should avail themselves of that right.

In material Trump voluntarily handed over in June, it was at the same time he was handing over those documents in June the FBI recommended he better secure the room that other documents were stored in.

If the FBI was taking boxes of documents in June, looked at other documents and found them to be classified why didn’t they take them then?
