General Flynn completely exonerated

In a 30-page court filing, Sullivanโ€™s lawyers on Thursday asked the full D.C. Circuit to take up the Flynn case and effectively erase the panelโ€™s split decision. Sullivan, represented by the prominent Washington lawyer Beth Wilkinson, argued the D.C. Circuit had prematurely intervened in the prosecution before the judge ruled on the Justice Departmentโ€™s motion to dismiss the case.

It's an en banc hearing (i.e., a rehearing by the full DC Circuit). Chances are they reverse and let Sullivan rule on the MTD. But guess what--that may not happen until after the election. Trump may have to pardon him after all.

I donโ€™t think theyโ€™ll reverse it, but I didnโ€™t think theyโ€™d take it en banc, either.

Apparently the circuit court panel ruling is now void so thatโ€™s interesting.
 
The issue they hinted they are interested in is whether this should have been appealed in the middle of the case. There are circumstances where that is allowed -- a case where an immunity issue arises for example.

The issue the full court will hear is whether it should have waited until the matter was concluded in the district Court, as suggested by the dissent in the panel opinion.

Everything I've read suggests it was a poorly reasoned decision. I think they reverse to give Sullivan a chance to decide the motion first, which he should have been given. Then Sullivan gets to dither around until the election is past, forcing Trump to pardon him on the way out.

Itโ€™s void now. I could see them issuing what would have been a concurrence to the former opinion. Same result. Better reasoning.

You might be right though. The mandamus was always a pretty weak challenge.
