According to trial evidence and police body-worn camera footage, as the officers struggled with the group of rioters, a male individual, later identified as Mark Middleton, pushed against the barricades and the police line with his body. Officers are heard on body-worn camera footage repeatedly ordering Mark Middleton and others to “Get back!” In response, Mark Middleton is heard yelling “f— you!” as he continued to push against the police barricades. Evidence showed that Mark Middleton resisted MPD officers, grabbed onto an MPD officer’s left hand or wrist, and pulled the officer forward towards the crowd.

At the same time, a female individual, later identified as Jalise Middleton, is seen on body-worn camera footage repeatedly grabbing and striking the same officer over the barricade with her hand. Another officer then approached to assist, and Jalise Middleton struck that officer as well. Video footage shows that the couple continued to grapple with and strike at the officers, and attempt to pull an officer into the crowd, as various flags were jabbed toward the officers’ faces.

Two federal judges agreed Thursday to postpone criminal trials for defendants accused of breaching the Capitol on Jan. 6, 2021, agreeing that President-elect Donald Trump’s imminent inauguration could make the proceedings unnecessary.

Over the objection of the Justice Department, U.S. District Judges Carl Nichols and Rudolph Contreras — Trump and Obama appointees, respectively — said they wanted to conserve court resources and avoid hauling in dozens of potential jurors for cases that might be called off in a few weeks.

It’s the first time federal judges have acquiesced to the demands of Jan. 6 defendants for delays in anticipation of potential pardons from Trump, who has pledged to grant clemency to many people charged for their role in the attack on the Capitol.

“There’s a real possibility of that happening,” Contreras said after granting the delay motion offered by defendant William Pope.


Pope, who is representing himself, had been slated to go on trial in December on misdemeanor charges. (A felony obstruction charge against him had already been dropped as a result of the Supreme Court’s June ruling on the matter.) Instead, Contreras is eyeing trial dates in late February.


Nichols, similarly, declined to set an imminent trial date for three Jan. 6 defendants charged with misdemeanors for trespassing in the Capitol. Without prompting, he asked prosecutors whether they expected the trial would go on even after Trump took over the Justice Department. When the prosecutor in the case could not confirm either way, Nichols opted to set an April trial date and postpone all other deadlines, allowing time for the Justice Department to recalibrate after Trump takes office.

Federal Court Rules Defamation Suit Against MSNBC’s Andrew Weissmann Can Proceed​

A federal court has denied a motion by anti-Trump pundit Andrew Weissmann to dismiss a defamation suit by former White House lawyer Stefan Passantino over false claims that he had coached a January 6 Committee witness to lie.


Weissmann is known for his hostility to Trump and his enthusiasm for “lawfare” efforts to target the President-elect.

 

Trump: I Will Start Pardoning January 6 Rioters My First Day in Office​


President-elect Donald Trump said Sunday on NBC’s “Meet the Press” that he was planning to pardon those involved in the riot at the U.S. Capitol on Jan. 6, 2021 as soon as his first day in office.

Host Kristen Welker said, “I asked the President-elect if he plans to follow through on his campaign promise to pardon those who attacked the Capitol on January 6, including the more than 900 people who pleaded guilty to a crime.”

Trump said, “I’m going to look at everything. We’ll look at individual cases. But I’m going to be acting very quickly.”

Welker said, “Within your first 100 days, first day?”

Trump said, “First day.”

The FBI only directed 3 Confidential Human Sources to attend the events of Jan. 6, 2021, Horowitz says​


Justice Department Inspector General Michael Horowitz said there were more than two dozen confidential human sources in the crowd on Jan. 6, but only three were assigned by the FBI to be present for the event, while stressing that none of the sources was authorized or directed by the bureau to "break the law" or "encourage others to commit illegal acts," Fox News has learned.

"Today’s report also details our findings regarding FBI CHSs who were in Washington, D.C., on January 6," the report states. "Our review determined that none of these FBI CHSs was authorized by the FBI to enter the Capitol or a restricted area or to otherwise break the law on January 6, nor was any CHS directed by the FBI to encourage others to commit illegal acts on January 6."

The report revealed that the FBI had a minor supporting role in responding on Jan. 6, 2021—largely because the event was not deemed at the highest security level by the Department of Homeland Security.

One of the three confidential human sources tasked by the FBI to attend the rally entered the Capitol building, while the other two entered the restricted area around the Capitol.

If a confidential human source is directed to be at a certain event, they are paid by the FBI for their time.
