I wouldn't either because he's human after all. However I don't think he does. It will affirm Dems protests and only make things worse for anyone who accepts a nomination to the court (if that's possible)

If there are enough votes to confirm he'll be given permission to vote yes, probably the same for McCaskill and Heitkamp. If the Rs don't have the votes no way the three Ds vote yes.
