Mike opened his “Frank-a-Thon,” an all-day interview, with Dershowitz by announcing that “My Pillow” is suing Dominion for $1.6 billion for violating their First Amendment Right.

Dershowitz explained why Dominion is guilty of violating the First Amendment Rights of Mike Lindell as well as the rights of the media to report the news: “We’re gonna sue you and put you out of business, and we’re not even going to let you see our source codes so you can see what we’re suing you about.”

Dershowitz blasted Dominion for refusing to share its source code. “It’s as if My Pillow ere accused of having some secret poison in its formula, and you couldn’t tell it by just looking at the pillow, and then somehow My Pillow said, we’re not going to give your our formula, we’re going to hide it from you. That’s what they’re trying to do. They’re trying to hide what they’re doing—at the same time that they’re trying to prevent you from entering the marketplace of ideas. They’re in the marketplace of ideas. They’re not only in the marketplace of ideas; they’re in the economic marketplace too. They’re to shut you out of being able to sell your products in stores. They’re trying to silence you, and they’re doing it as the government of the United States. That’s why I’m in this case.

Frank was set to launch yesterday but suffered some massive attacks. They are livestreaming for 48 hours and have numerous guests coming on to discuss what America is facing today. Over 65,000,000 people logged on yesterday.

(I don't know what the problem is but still unable to sign up for Frank)

Freedom of speech is not freedom of consequence. You can't just slander whoever you want and cry "but freedom of speech" when you get hit with a lawsuit. Not how it works.
I have no ideas how the courts rule on this type of thing but it seems like the stance here is that the "slander" was never proven one way or the other.

Would it be "slander" IF dominion actually had bad programming?

Not sure civil court is the place to find out. I dont know if there really is a discovery phase in civil courts which is what they should want.

Imo this is publicity and he wants to be the next Trump.

Is he suing for slander or a free speech violation?

This is so dishonest on its face. If some moron were to publicly accuse My Pillow of having poison in its formula with absolutely no evidence, the company would issue a cease and desist. If that same moron were to go on every national news show that would have him, and shouted the same nonsense before large crowds, My Pillow would sue the crap out of him. The absolute last thing My Pillow would do is go "Oh, you'd like to see all of our proprietary business secrets? Sure! Take a look!"

Seriously, f*** these clowns.

This this this.

I once filed a lawsuit and included in it a questionable claim that I believed I would be able to prove later. During a motion to dismiss that particular count, the Judge looked at me and said, "Son, it's ready, aim, fire not the other way around. Motion granted without prejudice."

As a side note, I have defended a few clients in front of that same judge and when arguing motions dismiss I usually lead with, "A wise man once told me it was "Ready, aim fire, not the other way around." I can just about always catch him smiling as he grants my motion.

Im on board with this 99 times out of 100, however, when it's elections, taxpayer money, etc. There needs to be full transparency. I think election confidence is incredibly important in our republic. If dominion does not want to hand over data, codes, whatever to the citizens then we, the people, should push to find a different contractor that will.

Nobody hands over proprietary information they spent millions to create.
