From what I gather this is a bit reminiscent of the Drejka and Chauvin/Floyd incidents. By this I mean initial reactions seem justified. Drejka was clearly assaulted and Floyd was absolutely resisting arrest prior to being put on the ground. The issue is where it goes from there. Drejka had justifiable reason to pull his weapon after being knocked to the ground and advanced on. What landed him in jail was firing after the person recognized he was armed and was moving away. Having Floyd on the ground to be subdued isn't a problem but kneeling on the guy well past his showing any signs of responsiveness is why Chauvin is in prison. I don't think (at this point) there's much of an argument this subway guy couldn't have been lawfully subdued. Questions begin with what took place afterwards and what culpability could be involved.

As an aside a rear headlock need not be an actual choke hold. I'm certain an autopsy will be done and a better read on actual COD forthcoming.
 
While I don't condone vigilantes, when Judges, police, etc stand down and allow citizens to be attacked on a routine basis by career criminals....you can't be surprised when citizens take matters into their own hands.

I don't think he was intentionally murdered, but unintentionally murdering someone is still a crime. Whether he meant to or not, the guy killed a man.

Manslaughter would still require proof of negligence. If I prescribe you penicillin and you die, sometimes people die. If I prescribe you penicillin even though it’s listed on your allergy list, that’s different. Now there’s negligence.

When you have a long history of violence, and are actively threatening people, it’s likely you may be restrained to protect others. When that happens, x% of people restrained due die from it. It’s rare, but it happens.

With that said, if it is proven the guy was unconscious for several minutes and he still continued to choke him, I would he on board with manslaughter charges

No one is justifying killing the man. But just like how x% of people will take the covid vaccine and die, x% of people required to be restrained will also die.

I’m curious what would change your mind on this issue. If he had swung at another passenger, would you change your opinion?

First off, the man who applied the choke hold wouldn't have known the other guy's history, so history has nothing to do with it. Only the actions that day.

Second, the actions of the man who applied the choke hold appear to have gone past the level of self-defense. From what I've read, I've seen no mention of the dead man having an actual weapon. Just the threat of physical violence. That threat was diminished fairly quickly. Intentional or not, the man died. The tweet was not wrong. "You can't just kill people". It's really not a hard argument to understand. Trying to absolve people of being responsible for their actions is a large part of the problem in this country.

He went from incapacitating him to killing him. How did it not go past self-defense? I don't believe the marine intentionally killed the guy, but he DID kill the guy. He should face the consequences of his actions. FFS. I don't think the marine is an evil killer. But that doesn't matter. This went beyond the scope of self-defense. Every one of those people had the option to walk away. The marine made a decision to take action, and that action led to a death.

You’re confusing the actions and the outcome. I could punch you in self defense and you could die from that. That does not mean my actions went beyond the scope of self defense.

He came up behind the guy and later told police the guy hadn’t attacked him (I think he actually said the guy wasn’t threatening him, but don’t have it in front of me.) That’s not self-defense, there’s no indication anything was happening to him

Even the Fox News article about 911 calls can’t avoid this:

Neely, 30, a Michael Jackson impersonator who suffered from mental illness, was acting aggressively and screaming at other passengers – but hadn't attacked anyone, according to a freelance journalist who recorded the deadly confrontation.

Penny, 24, pulled Neely to the ground from behind and held him in a chokehold as two other men helped restrain the agitated man. Neely initially flailed his arms, but within minutes, can be seen going limp in the disturbing footage.

At one point, a fellow rider can be heard in the video telling the men that it looked like Neely had defecated on himself and warning them to be careful not to kill him.
