droski, for what it's worth, clemens' attorney is even stating they can't go to court to challenge it.
 
i don't see how they couldn't sue for defamation. i think clemen's just doesn't want more stuff out in the open. his denial through his attorney was ridiculous. he's acting like he is guilty IMO.

Mitchell can't be sued for what he was told and reporting it, unless someone can prove Mitchell knew what he was being told wasn't factual. Likewise, MLB can't be sued unless they are aware that the info Mitchell released wasn't factual.

According to the journalistic law classes I have taken, it's actually quite difficult to prove defamation through credible news sources. This isn't the Globe or the National Enquirer saying this stuff. This is Senator George Mitchell and the Major League Baseball Empire. Getting anything from them is going to be very, very difficult.

you're best bet is to settle out of court, just to save face for the news service instead of the humilation of being on trial. However, Selig and Mitchell's plan was not to point fingers as much as it was to really get this out in the open for everyone to see.

Say what you want about Selig being an idiot, he knows this isn't going to make him look good now, but in the long run, it's the only way to rid baseball of the steroid issue. If you want to hate someone for ruining baseball, hate Donald Fehr and MLBPA for not allowing the commissioner(s) to do anything for over 20 years now. Selig knows this is the only way to get around having to screw with the players union.

And for anyone that really believed this would shut the door on steroids in MLB, Selig and Mitchell both knew all this was going to do was the blow the doors completely off. That's what they wanted to do. Personally, I say kudos to you, Mr. Selig.
 
the mitchell report was a horrible idea for selig. there were still idiots who believed that clemens and other all stars were clean. best thing he could have done at this point is act like it never happened. they can point to barry bonds as the cheater. now it becomes painfully obvious even to the most delusional fan that everyone was cheating. this is all about selig trying to preserve his legacy because he knows he will go down as the worst commish in MLB history (maybe sports history). somehow selig thought by doing this this would make him look like he actually cared about the steriod issue. the fact is that MLB knew the players were doing steriods at least 10 years ago and like the WWF encouraged it by paying these guys mega $$$$ the more roids they used.
 
droski, you really need to look into the limitations the commissioner's office has because of the ungodly power the players' union. No commish can succeed against it.
 
all naming names on the report did was conform the suspicions of baseball fans everywhere. i have yet to see one name on the report that shocks me.

likewise, just because somebody wasn't listed, doesn't mean they weren't or aren't doing it.

i don't agree. they looked the other way because mcguire/sosa were making them gobs of money. if they wanted mandatory testing they could have done it. public sentiment would have been 100% behind the owners. the players union would have had no choice but to eventually comply.

yup. all this did was confirm to me that everyone is doing roids. they have 2 guys from new york and that gave em 80 names. imagine if they had a guy in each clubhouse.

and that's what's happening now. That's why the policies have been implented. The first wave of testing was all the MLBPA would approve. When the publice wasn't satisfied, the MLBPA finally agreed to stiffer testing. It was Selig could get from the MLBPA, so he went this route. Now, we'll see if Fehr will completely back down. The owners couldn't go any further because the players wouldn't let them. Seriously, read up. It will help you out immensely.
 
right but this was done 4 years ago. the same process could have started 10 years ago. I read a lot, thanks.
