A potential rift is emerging between James Comey and John Brennan over who pushed to include information from the unverified Steele dossier in an intelligence community assessment of Russian interference in the 2016 election.

Comey, a former FBI director, sent an email to subordinates in late 2016 indicating Brennan, a former CIA director, wanted to include materials from the dossier in the intelligence community assessment, known as the ICA, Fox News reported.

George Papadopoulos, the author of "Deep State Target: How I Got Caught in the Crosshairs of the Plot to Bring Down President Trump," joined FBN's Maria Bartiromo Tuesday morning where he said investigators should examine the $10,000 cash payment he claims to have received in summer 2017 from a man he alleges was a spy.

"I actually want Congress, Barr, Horowitz, and Huber to review the bills because I still have the bills and I think they are marked," Papadopoulos said. "These bills that are still in Athens right now must be examined by the investigators because I think they are marked and they're going to go all the way back to DOJ, under the previous FBI under Comey, and even the Mueller team."

"If the Mueller team is going around entrapping campaign associates and Trump associates, the way they did to me — I am sure it wasn't just me they did it to — it's going to open up a massive can of worms," Papadopoulos said. "I think we need to get to the bottom of exactly not only how did this story start, but why were they entrapping us moving forward."

Nellie Ohr deleted emails sent from husband's DOJ account

Nellie Ohr, the wife of Justice Department official Bruce Ohr, told her husband she was deleting emails sent from his government account.

The revelation comes as both Ohrs remain under intense scrutiny for their ties to Fusion GPS and British ex-spy Christopher Steele, the author of the anti-Trump dossier that was used to obtain warrants to wiretap a member of President Trump's 2016 campaign.

Conservative watchdog group Judicial Watch obtained a series of April 2016 emails from a Freedom of Information Act lawsuit against the Justice Department that show a correspondence between the Ohrs, an aide to Bruce Ohr named Lisa Holtyn, and Stefan Bress, a first secretary at the German Embassy.

Emails previously released by Judicial Watch show Bruce Ohr acting as an unofficial back channel between the FBI and Steele. He was demoted when it was revealed he met with Steele and Glenn Simpson, the co-founder of the opposition research firm Fusion GPS, which commissioned Steele's work. Ohr also told lawmakers his wife shared a thumb drive with him to hand over to the FBI.

Nellie Ohr conducted research on connections between Russia and Trump, having been contracted by Fusion GPS.

Abstract

I argue in this Legal Opinion that Deputy Attorney General Rod Rosenstein's appointment of Robert Mueller is unconstitutional both under the test for officer inferiority set forth in Justice Scalia's opinion in Edmond v. United States, which is cited as good authority in Free Enterprise Fund v. PCAOB and also under the test for officer inferiority set forth in Chief Justice Rehnquist's majority opinion in Morrison v. Olson. Under both tests, Mueller is acting as a principal officer even though he has not been nominated by the President and confirmed by the Senate. Mueller's appointment is therefore unconstitutional.
