Players Don't Get Dismissed for Misdemeanors

Rob Lewis is now reporting that all charges against the 4 are misdemeanors.

We will have some suspensions, perhaps for Wednesdays game, and then all players will be back.

My biggest problem is with Tatum drinking while driving. I also don't like the Marijuana in the car.

The guns, I could care less about. I own 6 hand-guns myself. Yes, mine are registered and I properly stow them when driving, but the word "gun" alone doesn't send me into a frenzy like some. There is nothing inherently immoral about having a gun in your possession. Failing to have it properly licensed IMO is like driving without a proper license.

Tatum should get 2 games suspended for driving while drinking and whoever owns the guns and Marijuana should get 1 game. If any of the 4 neither own the gun(s) and can't be tied to the Weed, they should face no punishment whatsoever IMO.

If the felonies are true those players should be gone...otherwise a couple game suspension should be fine.

That is correct. All charges -- according to Rob Lewis who spoke with the Judge who issued the arrest warrants -- are misdemeanors.

The only reason they were charges as they were was because of where they were sitting in the car in relation to where the guns, marijuana, and alcohol was located.

What happens now is the DA starts negotiating with their lawyers and some or all cut deals. That's when the charges will be adjusted and/or dropped. For example, if all four fess-up that the gun under the passenger seat was Brian's, all charges against Tyler Smith will be dropped and vice versa. The only charge that is likely not to be dropped is Tatum's open container charge.

When all is said and done, I'd bet that 1 guy gets off completely, either Tyler, Brian, or Melvin, two others face a single charge (possession of marijuana or possession of a firearm) and the last (Tatum) is in the deepest trouble, which isn't as big as all the Weeping Wandas are making it out to be. He was driving with an open container and dollars to donuts the gun under the driver's seat is his. He'll face a couple of midemeanor charges.

If I had to guess -- pure speculation -- Melvin is getting off with no charges, Brian is facing misdemeanor possession of a controlled substance, Tyler is facing misdemeanor possession of an unlicensed and improperly stored firearm, and Tatum is facing the misdemeanor charges of having the open alcohol and unlawful possession of a firearm.

If Tennessee law is anything like Georgia, the difference between the charges above regarding the firearm(s) and no charge at all may be the fact that they were under the seats and not in the glove box. I'm going off memory here.

Send all four of them packing. This is pathetic, as bad as it is someone is going to have to be made an example. If they don't care anymore about being a UT Vol than that send them all home. Most probably believe this is a bit extreme but if we keep slaping them on the wrist their just going to keep doing it. They are an embarrassment to the University, the only punishment good enough for these four and that will deliver the message to the other student athletes is to dismiss them from both the team and the university.

"Tennessee will kick you off the team for making a simple mistake -- a misdemeanor. We understand at KY that everyone makes mistakes. If you deserve a second change for a minor matter, we'll give it to you. Tennessee won't."

You are so out of touch with today's 17 and 18 year olds. Might as well suggest we eliminate our basketball program.

Bull. One of the guns had a serial number filed off. That is serious. That is a black market illegal firearm. Quit being a homer. If this is swept under the rug, UT has got some big problems brewing inside the compliance department. If they get out of all this with a slap on the rist, do not cry and ***** and moan when a lack of institutional control is eventually landing on tennessee's campus.:bad:

So it is ok for college students whether they are high profile athletes or not to ride around smoking weed and drinking with an illegal sidearm. :huh:

in ONE YEAR the University of Tennessee campus has had SEVEN NCAA INFRACTIONS, ONE ONGOING INVESTIGATION IN RECRUITING VIOLATIONS, 7 PLAYERS ARRESTED CHARGED WITH ROBBERY, OPEN CONTAINERS, WEAPONS, ILLEGAL WEAPONS, DRUGS, ECT....

You think this all goes without notice by the NCAA?

You're misunderstanding his post. He's not implying that the compliance office for UT has anything to do with the problem. He's just stating that the office better not sweep this under the rug like it's nothing.

It's not NCAA rules as for what they have done & consequences either. It's the laws that has gotten them facing charges here & nothing to do with the NCAA.

Do you really think that of the top 50 high school basketball players in the country, they are more likely to have seen, touched, or own a gun or have a family member who is a law enforcement officer?

I'm sure the inner-city kids that we recruit in Memphis, Atlanta, and New York are appalled by the idea that there are basketball players in a car with handguns. OMG -- the shock.

Behold, the above is called making an argument. Perhaps you can practice it.

The serial number from one of the guns had been tampered. That's not a misdemeanor buddy. I hope you end up being right but right now it doesn't look that way. TBO, I feel these players need to go anyhow after this incident. I mean at least they're stoned players, right?

Would you want a bunch of stoned players on your team? Heck, no wonder they looked like they were stoned. It's because they were. :no:

Yea, sorry about the name calling. But I am sick and tired of our fans acting like this is all not a problem. We have HUGE PROBLEMS RIGHT NOW. People like you who keep wanting this crap swept under the freakin rug are why we never stop this crap. All four need to be GONE. lane Kiffin just swept the other incident under the rug. Now we will sweep this under the rug. When does it stop?

Being "out of touch" (which I think is a cop out) means nothing here. There are rules, there are standards, they need to be followed. If being "out of touch" means ignoring drug use, drinking and driving, and riding around with guns in the car, then I will be glad to be "out of touch" also. That is behavior that has no business being condoned at the university.

You are nothing more than a homer who will say anything and do anything to make everything go away. Your arguments consist of, "we don't know the facts"."All schools do it". "Inner city kids blah, blah, blah.".

Fcts are facts buddy. In both sports in one year we now have 7 NCAA infractions, one huge ongoing recruiting scandal, 7 arrest, DUI'S, Weapons charges, illegal weapons charges, possession of controlled substances(drugs), and a coach that praises and gets praised on NCAA rules violations. Give me one other school who has racked all that up in one year. Stop being a homer, and place a real argument.

Again, don't let any facts impede your rush to hysteria. Lane Kiffin dismissed the two players who were charged with wrongdoing. If that is sweeping something under the rug, I guess he should have randomly kicked off 10 more players to make things more severe.

College kids smoke weed. Inner-city kids often carry guns. Sometimes they drive without licenses and curse too. Me thinks you need to get informed.

If misdemeanors are dismissable offenses, we need to give back our 1998 national title in football and a lot of wins in the two major sports (as well as other schools) because we haven't been following the appropriate punishment standards for a long, long time and neither has anyone else in Division 1. I'd guess there is something close to 300 or more misdemeanors committed in the SEC by athletes in the last 10 years.

Time to get real. It has nothing to do with being a Homer and everything to do with being practical and level-headed.

You would probably stroke if you had any idea some of the stuff that has been swept under the rug in the last 20 or so years.

The circumstance of this incident in itself are sadly somewhat common. 80 percent or higher of college athletes probably smoke weed if I had to guess. And I don't want to know how many college athletes carry guns.

I don't like it, but let's not pretend we're the only place where this happens.

I am waiting to see a report refuting all other reported stories today.
