The NCAA got blindsided on this one. Politicians do not move this quickly unless they have their ducks in a row. NCAA's move was anticipated and out flanked.
Yes, this has been in the works for months. UT knew it was coming, assembled a legal team, mobilized support, developed strategy, drafted and redrafted legal docs, got approval up the chain, prepared to execute and did just that. UT warned the NCAA and so did the AG. I wouldn't say the NCAA was exactly blindsided. Underestimated Tennessee and miscalculated consequences-- obviously.
 
This may be a big ploy of self destruction, using Tennessee’s passion and fortitude to upend the AA, concerted by Saban and select AA officials be the create a new football league with Saban crowned as the commissioner. @LA Vol tell me I’m wrong.
They gonna mess around and wind up with Queen Donde instead. They poked a sleeping dragon
 
Ha, I want an underground shelter with strategic exits in case of a breach. Big enough for a shooting range. Storage space for a years worth of food and drinks.

I have definitely read too many post-apocalypse books. 😁

The truth is that Tennessee is going to pour millions into legally protecting NIL. And they are most likely going to win easily.

But the truth and the narrative are two different things. We were never going to get hit with a post season ban last time, and yet that was used against us repeatedly. I'm sure they will do the same thing again.

Remains to be seen which narrative will win out. I think the situations do have their differences. Since we pled guilty last time we were always going to get some kind of punishment. In this case, I think you can tell recruits we are going to get absolutely nothing handed down.
The narrative is already being played out in the media, and the narrative is a fact, that the University of Tennessee went scorched earth on the NCAA in defense of the student athletes right to earn compensation. The difference in this and last time is that the university is publicly defending itself, and the state of Tennessee, the national media, and even opposing fan bases all support us. Completely different situation than before.

Being honest, I can understand the inquiry into Florida. They promised a kid a lot of money to flip him from Miami, reneged, and the kid ended up at Arizona State. I could understand if they looked into Miami since their NIL seems to be funded mostly by a single booster, or was, it might have changed by now. But investigating Tennessee, a program that has attempted to do everything right with an abundance of caution, that's just stupid. Not to mention there are plenty of unrelated to NIL problems that deserve investigating in college football, like tampering. We have kids openly admitting schools tampered with them to get them in the portal, and the NCAA has done nothing. Complete quiet. No, they decided to go to war with UT. Complete stupidity on their part. They all deserve to lose their jobs.

I used to vehemently oppose student athletes getting paid. A full ride scholarship was enough and the revenue from football supported other sports. That was my logic. But when you realize the sanctity of “student athlete” is a farce and in the case of revenue generating sports has been a joke for decades, and that coaches are becoming multi-millionaires, it doesn’t seem quite fair to me anymore that the athletes aren’t being compensated fairly.

It’s better to pay them above the table than all the cheating nonsense that has gone on for so long. We need to stop acting like there is some purity in amateur college football. Hasn’t been for a long time.

Well, not to sound too much like Ayn Rand, but the ability to create ex post facto laws gives authority to make anyone a criminal at any given time, for any given reason. The desire to create ex post facto laws indicates the motive to make someone a criminal.

Almost all laws are ex post facto in the sense that they're made after something has occurred usually with the intention of either preventing the now-crime from happening or for the purpose of punishing those that continue to perform the now forbidden action. Tyranny enters into it when you try to apply new rules to events that have already transpired. IOW, law is based on the past but it applies to the future and that gives everyone a chance to comply with it. There's no choice regarding complying or not in the absence of the actual law. Ex post facto laws like you see with dictators are basically declarations that X is guilty.
