I did and the realtor said we could be sued if we backed out also started yelling at me

Hey, I'm starting to think that this is going beyond "treating good people wrong" and well into bad practice territory, bordering on legal action.

Did you know the realtor? This reads like they were pissed at you because they wanted their commission. They certainly didn't have your best interests at heart.

I think that Enki is right, you should have had 3 days to back out if you wanted to. I'd run that past another realtor that you know, or another group that you trust.

If you got $50k less than what you signed papers for (I tried reading back and may be misunderstanding), then you got screwed and should hire a lawyer. That’s just not a thing.

contract was for him to pay 600k for house, his ‘bank’ all of a sudden said he could not be financed for the approved amount (only put 3/5 percent down) and made him pay of his credit cards to them..(bank in New York with a lot of foreign names lol).. then said could give us 555k lol because that is what he could get financed.. our new house was 650ish range so we are dealing with some relatively speaking nice houses

This is super shady. I’m no realtor and I don’t have all the details so take with a grain of salt, but if the buyer is the one that couldn’t get the funds you should definitely be able to back out. They failed, not you. Maybe someone in this thread is a realtor and can expand on this. But to my limited knowledge this honestly sounds like your realtor was either really bad and doesn’t know their job, or they purposely mislead you. Maybe they knew the buyers? Maybe they just wanted it over with and to collect their commission? Idk.. but if I were in your shoes I’d talk to a realtor lawyer or another realtor that you may know outside of that realtor company you just used and then look at reporting that realtor to the realty ethics board if the lawyer or realtor says there is a discrepancy.

I have zero information on your contract but if the contract was for 600k and they can’t pay then they are terminating the contract and not you. I would definitely hire a lawyer and go after that 50k.

I am not going to make your relive a terrible experience, or suggest that you force yourself into a conflict with a buyer and agent that you don't want to deal with anymore, but this whole situation is red flag city.

That's a lot of money to leave on the table because the buyer had some shady issues and the realtor bullied you into making a deal happen.

Everyone else won (big) but you.

Not my situation, but if you were a family member I'd help you find a MBoro law firm that has been there for a while or a Mid-TN firm that specializes in real estate/property, and I'd start turning some people inside out.

I’m not a realtor but I feel like if he can’t get a loan for the contracted price then you can either lower the price (why would you do that tho) or he has to back out and you’re likely entitled to his earnest money. It sounds like your realtor is pressuring you into a sale so they can get paid.

In no way would someone be expected to go through with a sale that is $50k less than agreed upon. If it was me, I would let the realtor know that your next interaction with them will be through your lawyer.

The song is about rural Massachusetts, rural Maryland, rural Virginia, and obviously West Virginia.

The two original song writers were a married couple that were from Mass and Maryland, and they started writing the song while they were driving on back roads through rural Maryland on the way to a family reunion. They wrote it loosely about roads that they grew up on in Western New England and in the MD/VA area, respectively. They added features of VA because it was easy to fit in the song. The husband grew up listening to a WV radio station as they didn't get a lot of country in MA, so that inspired some of it, and he also knew other "hippies" from WV that he had met in song writing circles. John Denver loved the song because it reminded him of roads he grew up knowing even though he moved often (NM, AZ, AL, TX).

The whole point of the song is that anyone who has ever driven on a rural road or highway can relate to the spirit of the song. It was easy to write in "West Virginia" so the writers and Denver kept it.

I will help as I can based on the details provided. I am a Mortgage Lender but NOT an attorney.

1-There is no right of rescission on a purchase for either buyer or seller, this is a right for refinance transactions, certain HELOC's, second mortgage liens, and some other non applicable loans.
2-Caveat is I haven't seen the contract but, the contract was written to, agreed upon and "BOUND" based upon the agreed sales price. The reduction at the table almost certainly nullifies this. It is a material breach.
3-The realtor: They are licensed and have certain enforceable penalties for violating the terms. What I would recommend is find out who their principle broker at their office is. Inform them that you will be taking legal action based on your experience. The "Principle Broker" (your realtor's boss) is very much in a vulnerable position here. They will be highly motivated to make you whole.
4-Do not bluff, contact a real estate attorney and follow through, and do it without delay.
