No, but AJ has every right to sue her for lost wages/defamation/etc... he could take every cent of it if he wanted... open and shut case there

Actually they could sue AJ in civil court where the majority is necessary for guilt instead of 100% agreement. It might be to AJ's best interest to move on.

He has a right to. Its probably not as open and shut as you think. And its debatable whether he should.

agreed. it was a trash case and they actively sought to suppress evidence. That should not be the interest of the prosecution.

Except that might not do anybody any good. You see I wasn't looking for a porpoise. It's a dolphin that's been taken. The common harbor porpoise has an abrupt snout, pointed teeth and a triangular thoracic fin, while the bottlenose dolphin, or Tursiops truncatus, has an elongated beak, round cone shaped teeth and a serrated dorsal appendage. But I'm sure you already knew that. That's what turns me on about 'cha, your attention to detail.

But it's a rough toothed dolphin, Steno bredanensis. Also a melon headed whale, Peponocephala electra
 
I just wanted to thank some of you guys for being candid about some things that you have done that you are not proud of. We can all benefit from the lessons you are giving.

No, no, no. Still has to be unanimous. But the burden of proof is lower.

You would obviously know better than me but I thought in some instances it was a majority. Could other states be different? Maybe I've been watching too much courtroom dramas on tv. :)
 
I have 88 on ignore because he doesn’t drink coffee.

I have glitch on ignore because he told me he likes sleepless in Seattle and it made me uncomfortable.

It's the burden of proof that goes down. Not the number of votes. Its easier to get a guilty verdict because they only have to think there is a preponderance of evidence, not beyond a shadow of doubt.

A criminal case is beyond a reasonable doubt. You are correct that a civil verdict is by a preponderance of the evidence (51% is enough).

Right. I knew shadow sounded wrong. I always loved the law but never liked the amount of reading to go to law school. Hahaha. My roommate in grad school was in law school. He carried laundry baskets of books to and from his car every time he went to class.

I never read a whole lot either but made it through law school. I still don’t read much for pleasure.

I would never take the bar exam again. I got a logistics and transportation degree at UT and figured that I would do corporate work. I am now 13 years into criminal defense work.
